Hello everyone
I have gone back as far as I dare, this thread moves so fast and it is so pleasing to see how many success have been posted up. Brilliant and well done to all of you.
Its good to see there are newbies taking up the battle too in gettng back was rightfully theres.
Keep going all of you including those that seem to have hit a brick wall, you will make it crumble I am sure of that.

Sorry about your sister's condition, it must be very difficult for you all.
Just a thought, but have you let the FOS know of your sister's condition and that its getting worse?
You could request for fast tracking. Tell them you require for this to be resolved for ASAP as your sister will benefit from this.
If you've not done this yet then please do, it may help to have the case moved on quicker.

That's the funniest thing though; her disability was disclosed to everyone from the very beginning. I've heard a recording of her initial application where she explained that she had been disabled since 1981 (it was 2007 at the time) and her level of disability meant she received the higher rate of Disability Living Allowance. She was even asked to provide the letters confirming which rate of DLA she received as proof of income, along with a letter of self certification for her self-employment. The adjudicator at the FoS has also heard this recording, and was very much aware of my sister's disability, since the Claims Company fast tracked her claim to them, and the FoS spoke to my sis on the 27th of Jan. She then sent them a letter to confirm what she had told them, about her disability and her self employed income. Then at their request, shevsent them a record of her NI contributions since 2006, which clearly showed she hadn't worked enough to pay the level of NI to qualify for PPI.
She's had to literally do all the running around (not easy when you have cerebral palsy and often can't walk the bathroom without pain) and make the phonecalls to confirm the info had reached the FoS. As of April 27th it had, and she hasn't heard a thing since. What angers me is that she made her disability abundantly clear when applying for the loan, and her DLA award letters detailed WHY she received the higher rate. It makes me so angry that loans companies are allowed to get away with putting someone so vulnerable at risk when they have just asked for some help.0 -
help!!. ihad a loan with prestige finance with 2300 ppi.i wrote to them and they sent me a big letter saying that they were not paying caus i signed all relevant material.the loan was for 22.000 i had arrears at times.i paid in full in 2006 i had the loan from 2005.
do i have no chance of getting the money back?0 -

Blimey I feel for your sister, and of course you and the family, its a worry for you all.
So basically then (sorry if i missed this earlier) the case have been dealt with by a claims company, and they have not been keeping your sister updated as they should be then? Even though its with the FOS now?
Sorry to hear your sister is having this hassle, damn claims companies.
Have you tried contacting the Claims Regulation (MOJ) to maybe find out a bit more about this company?

Maybe they could give you some advice on how to deal with this company who seem to be lagging.
I must say though, in my opinion its a very stong case and it beats me why this is still going on, something not right here is it, I would make sure as well that the FOS are still dealing with her case as a fast track, because if its moved from one to another it can easily be missed.

You can still fight this, it maybe a standard fob off, despite signing the relevent paperwork you may still have your reasons, maybe you were pressurised into signing them, but for whatever reason you do have, keep at them.
If this was not the final decision, then write to them again and ask them to reconsider and supply further info, tell them your not happy with the decision and believe they overlooked and so on........whatever the reasons you have.
Normally the final decision will give you details of taking your complaint to the Financial ombudsman service, if you have received this then take your complaint to these, but otherwise write back as stated above.

yep they said this was a finl decision and that they had the phone call....should i ask them to provide that phone call?0

i also had a mortgage with abbey that was always in arrears every month...was struggling with payments.i sold my house and paid of my mortgage.can you reclaim any of those charges back?

As far as the history of the claim is concerned, my sis filled out all the paperwork to get the ball rolling with the claims company back in April 2010. By July 23rd GE had written back, basically telling her to sod off.
The claims company were very much aware of my sister's disability so they sent the case to my FoS who had a long discussion with my sis on Jan 27th of this year. Further documents, detailing the NI history were to the FoS and confirmed when my sis phoned them on the 27th of April. No contact from the FoS since then, a generic apology letter from the claims company arrived on June 11th, but nothing else.
Last night we trawled through her bank statements, and calculated that to date, £10,730 has been repaid. The original loan was £10,000 at an interest rate of 9.34%, which has since changed to 10.6% per annum. Of course, with the added PPI the original total borrowed was £11787, which meant that £100 of the monthly repayments of £242 was interest. The current outstanding balance, according to GE, is £4220.45. It's a terrific result for the lender, but just proves how much of a dog-eat-dog world we live in, and when it comes to making money from somebody, the fact that they're disabled doesn't really appear to matter.0 -

I agree with Di completely.
This should have been settled - something is not right here.
I'd keep on at the FOS and the claims co - dont give them any rest.
