PPI Reclaiming successes and failures

Just received £1,200 from EGG within a week of sending a claim letter based on MSE/Which templates. The only downside is that they have deducted it from what I owe even though I have a repayment plan that I am sticking to. I would have like to use some of it to clear other debts, can they do this?0

Unfortunately it seems this is the way its done, even if an arrangement have been put into place.
You could write back and argue that you have for example secured debts that you would have used the refund for, or maybe mortgage or council tax arrrears if any which are more important than that of unsecured debt.The one and only "Dizzy Di"0 -

Well done for getting your money back I am really pleased for you.
How is it though that some people can get their money back more or less straight away and others just keep getting letters saying they are still looking at it. I had yet another letter stating that even after 8 weeks they still hadnt made a decision and I have to wait longer. It just doesnt seem fair!!0 -

I had submitted a claim on my wife's behalf to Capital One for PPI on her credit card balance over a number of years, which they rejected. Having used the templates from this site and followed the process suggested I referred it to the FOS only to have it rejected saying:
" I accept Capital One may not have adequately explained the ongoing cost of the policy and potential monthly benefit that would have been paid in return for your premiums. However, even if Capital One had done so, I am not persuaded this would have effected your decision to take out the policy. I think it is more likely than not that you would still have purchased the policy if you understood exactly how much the policy would cost and the potential amount you would receive in benefit in the event of a claim."
He also goes on to say the Capital One have no recording of the sales conversation but that it would be unreasonable to assume that the sales person would have deviated from the approved script which seeks acceptance useing the words "are you happy for me to set this up for you today".
We had originally complained on the grounds that the policy was mis-sold because no consideration was given as to whether it was suitable for my wife's needs and her existing provisions were not discussed. Shje was not asked if she already had a policy. As her employer provied 6 months full pay and then half pay indefinitely, and I had more than enough savings and investments to cover the credit obtained, PPI was completely unnecessary. I am surprised by the FOS ruling and am seeking help in an appeal.

Hi Roger and welcome.
I take it this decision was made by the Adjudicator and not the Ombudsman himself?
Please correct me if I'm wrong, but normally you do have the opportunity to have your case reviewed by the ombudsman.
Have this been mentioned?
If this is the case, then if you can provide further info to them, and tell them you want this reviewed.

Do you have any bank statements from the time you were paying the loan? all you need is the account number to put a claim in.
People have won with ppi from the 90s, but they had the account number.
Dont think a SAR will do you any good and this will cost you £10, only for them to say they do not hold any info because of the length of time.
You may stand a chance if you could find the account number.0 -

I Would call into your local branch and speak to the branch manager.
Do this personally, if contacting them by email or by phone its highly likely they will tell you they cannot find them (as they have done to many who have later found the details) even from loans taken out previous years.
My brother in law was in the same situation then later called into the branch in regards of a loan taken out in 2002 and they came across the details.
I was just recently successful in reclaiming loan ppi from lloyds and they were older than yours. Give it a go, or check any old statements if you have them, if you bank online this should allow you to go back to 2002 with Lloyds TSB, the loan acc number is shown next to the monthly loan repayment.
You can then if mis sold, make a reclaim by following the procedures on this site, by completing the questionnaire, or go directly on Lloyds website and follow the details on there, its the same as on here, good luck.
