On The Back Of The Credit Agreement It Do Mention Enforcable What Does That Mean As Iv Been Hearing This Word Mentioned.

Hi, Yes you can ask for figures prior to accepting otherwise you wont get what is rightfully yours.
I have claimed back from BOS, they didn't say no, they said they would refund me without any argument, i have finally got my £3200 back, and also, 14 days later, they wrote to me and said they would refund me the 8% i asked for and within 3 days of receiving that letter, i have a further £1099 in my bank. They also reduced the loan from £4k to £600, not sure who they have doing their calculations but i am happy with that... :TGo for it, they are not as stingy or argumentative as other banks. you will get the refund via cheque.

I sent in the complaint in late July with just the template letters to the branch. It was not acknowledged after 6 weeks. Therefore I sent it to the customer relations manager again with all the facts and threaten to claim compensation of distress.
I received a phone call around a week after that. The Indian operator first denied any wrong doing and insisted that I signed the legal document for taking out the PPI. But insisted that I was mis-sold. He gave in and asked me what did I want to resolve the case. I told him that I wanted all the money I paid in plus all the interest (inc 8%).
Last week, I received another phone call from a nice lady confirming that they have made an offer to fully refund me with all the interest and 8% on top. I received a letter a few days after that.

I got over £5,800 Back from NATWEST It took a long time over 12 months and i had to send 2 letters and they kept sending letters to say they would deal with it within 4 - 6 weeks, so evebtualy I went to the Ombusmans and then had to wait while they contacted NATWEST and then send the Ombusman a 2nd letter to say that i had heard nothing back from NATWEST then i was sent a letter offering to give me back the money i had paid so far with interest and an additional amount for my troubles. I used all the standard letter form this site and it was so easy NATWEST just dragged it out and made it take so long THANKS MARTIN0

Thanks for the advice regarding reclaiming,
I wrote to HSBC regarding a personal loan which I had taken out in 2005. The loan had since been cancelled and I had been refunded a small part of the PPI (which was all paid up front). I wrote using a mix of the template on this site and the which? guide, asking for the money to be returned as I was unaware that the loan was optional and it did not meet my requirments. It took a few weeks, but they wrote back and without question repaid me just over £3000. Very, very worth while!0 -
Hi All,
Can anyone advise me how whether RBS are likely to pay out my PPI and if so how long it may take. The bank has not provided me with loan agreements when I have asked for them several times. I have sent a letter off explaining that and they sent me a form to fill in.
I am worried that they may try to fob me off with a lesser amount than I have paid to them.
Has anyone had any experience with them?

hi lozza001, I have just had success with RBS thanks to the Ombudsmen, had 2 loans with Lombard Direct who are owned by Royal Bank of Scotland, just yesterday returned the acceptance of offer for £4,906.
I sent letters from this site back in April to Lombard, got the standard no letters, and final response, so I sent it all onto the Ombudsmen, after many months of waiting for an adjudicator, they upheld my complaint and told RBS to refund PPI plus interest charged, plus 8% interest.
They are worth there weight in gold - the people who work for the Ombudsmen Service - It takes time due to there workload, but well worth the wait.
Am now waiting for an adjudicator for my claim against Lloyds PPI, sold in much the same way as RBS (but were business loans) so fingers crossed.
My advise to everyone, is keep going, dont give up, its so worth it in the end

Reclaimed PPI on an RBS loan

After 8 weeks they repaid over £4000 to the loan account and gave us £2000 in returned premiums we had paid over the past 2 years.
We were sold a PPI on a loan with the RBS in October 2006 and at the time my husband was self-employed and even had a business account with the same branch. We thought the insurance covered us both as it was a joint loan, but after I was diagnosed with a chronic, progressive disease earlier this year I rang the insurer only to be told I was not on the policy.
We then downloaded Martin's template letter and sent it off, stating that it was missold as my husband was self-employed and also because we thought we were both covered.
They investigated and kept us informed all the way along, and after 8 weeks wrote to say that they couldn't form a definite idea about what was said in the loan inteview as the member of staff had since left the bank, and therefore couldn't accept liability. But as a gesture of goodwill they would repay over £4000 into our loan account to recompense us for interest paid and calculated, etc. and also would pay over £2000 into our current account as repayment of the premiums we had paid over the past 2 years.
They have also cancelled the policy as it is no good to us and our monthly repayments on the loan have gone down by £100 per month
So I would call that a result and would like to thank Martin and the team very much for helping us to do this.
I would urge anyone in a similar position to do it - people do win and it's a good feeling!:j

Thanks for your replies. There is hope yet then hay? We are just going into a DMP so any extra pennies make a great big difference.

Just to let people know that the effort is worth it!
Myself and my husband had a £15,000 loan with Sainsbury's (who in turn used Bank of Scotland) over 7 years. It was paid off last year, but I knew I'd paid a huge amount of PPI. I asked BOS for the money to be returned using one of the templates on this web-site...they refused twice, so I went to the Ombudsman. Within 2 weeks I had a letter from them saying that BOS (now HBOS) were to return all PPI payments plus interest as a gesture of goodwill. I received a cheque for £4885!!! I was stunned. Then, the icing on the cake...a week after the cheque was cashed (and spent!) I received another letter saying I was to receive £1500 in compensation. So all this just shows it is worth it. Not bad for a total of 2 hours work is it???
