I have just filed a claim with MCOL for PPI paid on a HFC/Beneficial Visa card. HFC declined to pay and fos were unable to help as there was no original paper work. So this is really my final option. It has cost me £100 and I am feeling a bit nervous about what I have let myself in for but I feel that if I don't do this I will always wonder what might have happened. I'll keep you posted! Any advice welcome!
Best wishes
Hi franjam
Just to ask, but the loan company should be able to provide you with your agreement free of charge or maybe charge a £1 for this.
However if this was over the last 6 years you could request a SAR, known as a Subject Access Request, where you pay £10 cheque or postal order.
You recieve everything they have on you, this will prove you had ppi etc, any tel calls may have been recorded where they would and should supply the disc.
They have 40 days to get back with all this info, if they do not send with your request you can complain about this to the ICO known as the Information Commissioners Office who will look into this for you, on the SAR side of things (your data).
If you want the SAR template please pm me and I will post this for you, or it will take up so much room posting on this actual thread, or come over to the ppi reclaiming-discussion forum where we can help you further.
Good luck anyway.;)

With people that have successfully claimed with Egg have you also been able to reclaim the interest charged on that PPI or simply the cost of the PPI when you took out your loan?0

Hi there and thanks for this info. I am embarrassed to admit that I took out this card in 1992 which is why there is no record of the agreement available. I still have the card and during all this time have been very happy with it. This was the first credit card I ever had, and my only one until 2 years ago, and I had no idea what PPI was so just innocently paid it every month. I thought it was insurance incase someone stole my card and thought all cards had this as part of the deal! When I realised what PPI was after seeing Martin on TV it took me a while to work out what to do. I have info going back for 6 years and that is what I am trying to get HFC to make me an offer on. I've gone down the route of "on the balance of probabilities etc etc" and would like them to meet me part way. Anyway I'll keep you posted and thanks again.
The thing that would stop your claim here is that neither of you actually have the agreement now.0 -

Have just had a letter from FOS today saying that they have upheld my complaint and Barclays have agreed to settle my complaint. I don't know the amount yet but somewhere over £3000.
In case anyone else is patiently waiting, my timescale went like this:
Dec 07 - First complaint letter to bank
Jan 08 - Negative reply from Barclays, Leicester Customer Relations
Feb 08 - Second letter to bank
Feb 08 - Final NIL response form Head Office
Mar 08 - Complaint lodged with FOS
Jul 08 - Complaint allocated to adjudicator
Oct 08 - Happy ending :rotfl:
Will let you know when they sort it and payout, it will be to me as I repaid the loan early in May.
Have received payment from Barclays ... a fantastic £5739.62 !!! :j0 -
The banks are all struggling, we're all going to find ourselves struggling to get mortgages and credit and people here are celebrating getting money back from banks that they only paid because they were too lazy to read what they were signing in the fist place. Take some responsibility for your own actions and stop behaving like victims. I'm sure things would be different if all these people had lost their jobs and had to claim against the policies.
I used to think this website was great and I've benefited from, and contributed to, tips for saving money but I'm tired of the 'get back at banks' themes that this website promotes.
Maybe you'll all only be happy when everyone who works for your local bank branch is out of a job. And then you'll moan that there's nowhere to get your cash out of an ATM for free...0 -

Urmm, what's that all about. A lot of people that are claiming back their PPI's are doing so because they probably wouldn't have taken them out if they'd have been given the choice to do so. I for one was told by Egg that I HAD TO have the PPI otherwise they wouldn't have given me the loan - that's plain wrong so I will be claiming against Egg.0
