He cannot remember whether he took out PPI insurance on this loan or not - I also have, what I think is, the last 4 digits of the account number. If you were him would you write asking if he had PPI or just send off one of the FOS forms.
Also whilst he was looking for the original agreement which he was convinced he still had (he obsessively throws everything away) we found a booklet from Creditcare Silver from another car loan that we took out 11/1/1999. This gives us the details of the policy number and the finance company - Forthright Finance, dates, etc. Does anyone think it would be worth sending this off too? We should never have been given PPI as we both got paid from work if we were off sick or illm, etc. If so does anyone have any information on Forthright Finance please or any advice?
Thanks
Hiya
Yes anything is worth a try if you believe the ppi cover was mis sold to you.
Its up to you if you want to continue with the reclaim with just using the last few digits of the loan number, but otherwise contact them by telephone or email if you have the email address and ask if they can confirm if any ppi was added to the loan.
And of course you were already protected by the employer, if this was discussed when this was sold to you then maybe then you would have had the opportunity to turn down the ppi, but they obviously did not go through the details with you.
Good luck. The one and only "Dizzy Di"0 -
Does anyone have the addresses of Black Horse and Forthright Finance to send off the claim forms, please?
Thanks0 -
Hi,
I sent a letter (using the MSE template) to MBNA asking for the credit agreement for a personal loan I took out with them, which I eventually paid in full in 2008. I don't have any paperwork, other than a letter from 2008 stating the loan had been paid. However, I'm certain I was charged PPI, although I don't have the original agreement.
This morning I received a letter from MBNA confirming the loan had been paid in full, the account was closed and "as such, (by virtue of section 77(3) (a)) section 77(1) of the Consumer Credit Act 1974 does not apply".
What does this mean? Where do I go from here? Is it MBNA's way of stalling? Any help/advice would be gratefully received as I'm unsure what to do now? This is my first post on MSE.
Many thanks.
Hiya
I had this problem with one of mine, different bank though, because the account closed a few years ago, they may not longer hold these agreements, but they should still hold details of the loan and if ppi were sold and so on.
With SAR requests, they must comply and send documentation they still hold on the account(s) at least the last 6 years, so there is bound to be some details in relation of your loan account.
More details with letter template of a full SAR below, this howver though costs £10 cheque or postal order, if you had a few accounts taken out with them, then one SAR is sufficient.

Because I knew for definate I was sold and mis sold the ppi, I just continued on the reclaim in the end anyway, and was still successful, mine was from even previous years.
So you could still continue to reclaim if you want to.
Or maybe contact the bank and ask them outright about PPI.;)

Hi Rosie,
it means they're being less than helpful!
They are quite correct that they do not have to respond to a Section 77/78 request once the loan (or card) is settled (the request has to be made "in the lifetime" of the agreement)
However, you can get round this situation by requesting all the data they hold on you under Section 7 of the Data Protection Act 1998 (this is known as a Subject Access Request, or SAR)
They are entitled to charge you £10 for this, but if you are claiming PPI I'm sure it will be worth it
Try something along the lines of -

REQUEST UNDER SECTION 7, DATA PROTECTION ACT 1998
Account number: XXXXXXXXXXXXXXXXXX
Dear Sir/Madam,
I refer to the above agreement number
Under Section 7 of the DPA 1998, I enclose a cheque for £10 payable to you (being the maximum fee applicable for such a request) and respectfully request that you supply the following information on the agreement:
1) A copy of the agreement and any terms and conditions referred to theirein (together with any changes made to those T and C's during the life of the agreement)
2) A copy of any applicable insurance policies integral or external to the agreement and their full terms and conditions (together with any changes made to those T and C's during the life of the agreement)
3) Copies of any and all communications between you and myself (be that via email, telephone, fax or another communication medium)
4) Copies of any screen notes made by your employees (or third parties) on your system with regards to myself or my account
5) Copies of any and all communications between you and and any third party with regard to my account or myself (be that via email, telephone, fax or another communication medium)
6) Any and all other data held by you on my account or myself in any form, where this data has not been detailed in the above
I require that the requested information be sent to me within the statutory time limit of 40 days and that, should you have any issue with supplying such data, you notify me of this by return of post.
Yours faithfully,
X

Hello! Wonder if you could help? I am currently in the process of reclaiming PPI from British Credit Trust, the ombudsman found the case to be in my favour in Feb of this year but I still havent heard from BCT. Do you have a contact name and/or email address as I seem to be getting no-where via telephone?
Hope you can help & congrats on your refund!

Hi Jane, well done;)
Have you informed the FOS that your still waiting to hear from BCT?
I would chase them up on this, then they normally do this on your behalf if you haven't heard within I think either 4 or 8 weeks after the FOS sends back your signed acceptance.
I take it you have signed to accept and sent back the acceptance to the FOS a while ago then?
Cheers x:beer:The one and only "Dizzy Di"0 -

What were you reclaiming:
Credit Card PPI
Who was the provider:
MBNA
How much did you get back:
Total PPI back to Dec 99 when I took out the card £5336.90
Total interest associated with PPI Premiums £4922.30
8% Interest £34.97
Total amount payable £10294.17
This was credited to my card immediately clearing it and the balance is coming to me in a cheque format.
What did I do?
16th June 2010; Followed the steps form this website used the downloadable letter template and requested a list of insurance charges.
30th June; Confirmation that they had received my first letter.
26th July; Received the full list of insurances charges, a shocker!
27th July; Downloaded and completed the form from this website and sent it off.
7th Sept; Letter advising my claim was being looked at and would contact me within 28 days.
27th Sept; Letter apologising for delay and would contact by the 25th Oct.
20th Oct; Letter advising all claims on hold pending legal fight.
25th Oct; Letter advising my claim still not sorted and that I could contact the FSO if I wished, I decided to sit tight as my thinking was my claim might be in a queue and didn't want to join a new one with the FSO as I expected a lot of people to contact them.
There was now a long silence and with work commitments and Christmas it dropped off my radar also.
23rd May 2011, Letter advising my claim had been upheld in my favour.
25th May 2011, Letter advising me the above financials and that my PPI had been cancelled a bit like this card once I get my money back.
It took the best part of a year and I have accepted their offer which wipes out my biggest debt completely with cash coming back.
Found the process painless and easy thanks to the info on this site.

Well done, brilliant result. Thanks to all the competition posters.0
