Complaint: EGG Card Repayment Protection
Result: Success
After getting dangerously close to the limit on my EGG credit card, I started paying a bit more attention to my monthly statements.
On doing this I realised that I was getting charged for a Credit Repayment Protection that I had never requested.
I promptly phoned them and wrote a couple of e-mails complaining about this. Although I mentioned the FOS, I never actually went to them.
This morning (about a week and a half later) I received a letter detailing that I would receive a full refund of all charges over the past 6 years, including an extra 8%! :T
I was also told that depending on the outcome of a current judicial review, I may be eligible for a further refund and that would be issued accordingly.
So a good result and fairly painless overall.
Refund was £347.29 :beer:0 -
This is a long one, so please bare with me.
In January this year I wrote to Barclaycard to inform them that i fealt I had been miss sold PPI on my credit card. I sent the usual letter and received a standard reply telling me they would respond by........... They didnt - so I wrote to them again. Still no response...... In mid March I wrote to them and informed them that until I received a response to my letters I would be making no further payments to them and that I considered my account to be "in dispute"
Finally I received a response this morning to which I am a little concerned. They say that when I aplied for the card in 2003, I also completed an application form for PPI. They have enclosed a copy. They also claim that it is their
"policy to ensure that customers are aware of the features and benefits of PPI before proceeding with the purchase of the policy. To this end our applications have specific information relating to these features and benefits at the point where the PPI is offered.
In line with the requirements of the FSA we provide the following at the point of sale
* The principal details of the cover provided by the policy and associated benefits;
* Details of any significant or unusual restrictions or exclusions e.g. pre-existing medical conditions;
* The suitability to those who are self-employed, on contract or part time work;
*That cover is optional and will not impact on our application decision; and;
* The price of the policy"
They then go on to say that "having reveiwed the original application, it apears that you did select the option for PPI. As you requested PPI on your application form, and we have evidence of this, we are therefore unable to uphold your complaint."
What can I do next? If anything??
Hiya and welcome
Don't leave it there.
Stand your ground, this is just one of their normal letters that many receive in hope you will not go on any further.
For the agreement is what we all sign, but that does not mean you don't have reasons for not being mis sold.
So if they did not confirm it was final, write back, ask them to reconsider, give them your own timescale, for example a fortnight etc from the date of your letter, try to give further information on your reasons, and tell them despite you signed your agreement you still believe you were mis sold the PPI.
Then if they do not change the decision, complain to the FOS.
If that was the final decision then complain to the FOS anyway.
Keep at them, good luck.The one and only "Dizzy Di"0 -

Thanks for your help Dizzy Di.
As they had failed to respond inside the set time, and despite two reminder letter, I have already submitted my claim to the FOS. As I said in my original post, bacause they had completely ignored me for 3 months, I cancelled my direct debit. This IS NOT because I cannot afford to pay it. It was purely to attempt to hasten their reply.
Now they have responded (even though I do not agree with their answer) should I re-instate my direct debit and pay my missing installment?
Thanks in advance for your assistance0 -
