    Just goes to show how different these banks choose to operate. Had two ppi claims going, 1 from last July and the other from last November, and decided to take Anna* lead and email the ceo of mbna and the lloyds banking group. both cases had been pended due to the JR, but within a week of sendig the emails i got a refund letter from mbna, and yesterday banked the cheque for £3645.00. Now the halifax (lloyds banking group) are another matter. Not even the courtesy of a reply after sending a reminder after 1 week!! Shows total contempt for their customers I think. However, it does not end here and I will be sending further reminders via recorded delivery.
    :T Well done :j:money:

In mid March I wrote to them and informed them that until I received a response to my letters I would be making no further payments to them and that I considered my account to be "in dispute"

    Finally I received a response this morning to which I am a little concerned. They say that when I aplied for the card in 2003, I also completed an application form for PPI. They have enclosed a copy. They also claim that it is their

    "policy to ensure that customers are aware of the features and benefits of PPI before proceeding with the purchase of the policy. To this end our applications have specific information relating to these features and benefits at the point where the PPI is offered.

    In line with the requirements of the FSA we provide the following at the point of sale

    * The principal details of the cover provided by the policy and associated benefits;

    * Details of any significant or unusual restrictions or exclusions e.g. pre-existing medical conditions;

    * The suitability to those who are self-employed, on contract or part time work;

    *That cover is optional and will not impact on our application decision; and;

    * The price of the policy"

    They then go on to say that "having reveiwed the original application, it apears that you did select the option for PPI. As you requested PPI on your application form, and we have evidence of this, we are therefore unable to uphold your complaint."

    What can I do next? If anything??

    Hiya and welcome

    Don't leave it there.

    Stand your ground, this is just one of their normal letters that many receive in hope you will not go on any further.

    For the agreement is what we all sign, but that does not mean you don't have reasons for not being mis sold.

    So if they did not confirm it was final, write back, ask them to reconsider, give them your own timescale, for example a fortnight etc from the date of your letter, try to give further information on your reasons, and tell them despite you signed your agreement you still believe you were mis sold the PPI.

    Then if they do not change the decision, complain to the FOS.

    If that was the final decision then complain to the FOS anyway.

    Keep at them, good luck.

    Thanks for your help Dizzy Di.

    As they had failed to respond inside the set time, and despite two reminder letter, I have already submitted my claim to the FOS. As I said in my original post, bacause they had completely ignored me for 3 months, I cancelled my direct debit. This IS NOT because I cannot afford to pay it. It was purely to attempt to hasten their reply.

    Now they have responded (even though I do not agree with their answer) should I re-instate my direct debit and pay my missing installment?

    Thanks in advance for your assistance

    Hiya and your most welcome.

    What I would like to say if you don't mind ;).....is just be careful they don't start defaulting your account, but yes I would personally reset this back up if you can.

    I understand this have happened to others, but contact them as soon as you can and tell them you want to reset the account back up for as soon as possible to avoid this from happening, it should be ok.
    Good luck.

    Something else to consider dependant on how much you are looking to claim back; if you emphasise you will go to FOS, this will be considered by the bank for more than one reason- if FOS take on the compalint, the bank is then subject to a case fee which is payable by the bank whether they win or lose- this is presently £500, so if your claim is less than this figure and they don't have a 100% solid case for not paying you back, this might encourage them to pay you. Not only that, FOS cases take forever, and someone at the bank has to be employed to deal with the resultant correspondence and investigation.
  • Thanks Lone Ranger.

    I have already sent my claim to the FOS and they have sent me a letter to confirm that it has been received. I understand this is likely to take a long time. However, my claim is likely to be in the region of £2600.00 so I guess Barclaycard will do their utmost to argue the point
  • Good morning everyone!

    After success with getting my PPI back from Egg to the tune of £6500 3 weeks ago, I decided to chance my luck with my new found confidence and attack Barclays and Capitalone.

    I sent my letters and info off to both 2 weeks ago, and this morning in the post, Barclays have upheld my complaint, and a refund o £6000 will be paid to me in the next 14 days. RESULT!!!!!!! :j:j:j:j:j

    Capitalone also wrote this morning with the usual, we're looking into it letter. Hopefully this will be a success too.

    Thanks once again to all of you for spurring me on to take on the banks. I am so happy, I could do a little dance in my PJ's. !!! A great start to my day off. :D

    Hi

    I am new on here so I apologise if this question has already been asked. A number of weeks ago I sent off a PPI claim to Halifax Building Society and a week ago received a phone call to my place of work from a Halifax representative wanting to ask me a few more questions about my claim. He asked me if I was able to discuss this with him unfortunately I was unable to talk to him at that time to which he replied, well then we cannot continue. I asked him if he could post me out any further questions he had. To date nothing has been received. Have I blown my chances of a reclaim or what can I do next?

    Any help would be appreciated.
