Had some good news today from barclays re my complaint. Originally complained over the telephone mid november 2010, received a payment of £2100 into my account today. Appalling customer service though - told them about 2 additional loans on 30 november which they forgot to log. They finally logged them after my weekly telephone calls a week ago. Got told today that these 2 fall under the bba case and will have to wait for the ruling. Does anyone know the criteria for cases falling under this ? The reasons for complaint were the same as the reason on the upheld case. These were older loans dating to 2003 and 01. I am hoping this is not to do with some magic date that barclays have decided to use as a cut off point.

    Hiya

It maybe the case that its pre 2005, but the FOS will confirm this to you if you ring them as a general query.
    Good luck with this.

I contacted the PPI Customer Care team and they confimed that it was only for the 1st policy as they are still to refund me for my 2nd policy.

Thanking you all again for your help folks, you are all the best

I am DELIGHTED to say that this PPI issue has now been resolved

In Dec 2010 RBS refunded my payments and interest to the loan which I took out in 2003 which was £757.23 & £294.68 interest

2 Days ago I got back my premiums of £772.34 & £377.30 interest which they used to reduce my loan instead of crediting it to my bank account

Yesterday My bank account got Credited £4,210.56 which is the loan refund for my 1st loan which then got topped up in 2006 and they also paid £591.17 in interest, it could have been more but the RBS took of me £946.77 for the loan arrears

So all in all I managed to get back £7950.58 in paid premiums and it doesn't end there

My loan balance at the time was £14863.97 has now been reduced to £10625.54

This is what I call a succesful WIN :j:j:j

Many thanks to everyone from Martin Lewis for having the PPI letters that we can use on this site and to everyone one of you that took the time to answer my questions that I had.

While I started this fight with the RBS in March 2009, I would say to those who are still fighting, keep fighting to the end, YOU will get your money back as I have done

Now I am off to drink a well earned beer or two

They have 8 weeks to reply to you, what they did was sent me a letter saying that it wasn't mis-sold and offered me a good will gesture of £750, this is to fob you off, once you get that letter, you can then send your complaint to the FSO and they will look into it

Be WARNED, this takes a long long time, I started my complaint on 11/3/09 and it was only now that my complaint has been resolved

I wish you all the very best and I hope you are successful in your fight

    Hi Tony

The decision is now yours, but please also be aware, it may also take some time with the FOS too, due to large volumes of complaints, maybe give it a little longer (its up to you though) say a month or so and if nothing is heard by then - then move on to the FOS.

Lots of people have been in the same position, but your entitled to either wait longer or now complain to the FOS, you do what you feel is right for you.

    Good luck.;)

Hi there, it is up to you, you can wait or take this to fos now and tell them that they are holding on to your claim because of the review, at least if you do it now then you will be closer to getting it looked at. If
the bank start paying out claims after the review
( hopefully the fsa will win) then you just notify fos and they will not deal with it.
