PPI Reclaiming successes and failures

    My husband is an ex military fast jet and therefore recieves a military pension . We took out a new mortgage in 2004 in order to move house after my husband had left the military and were sold a mortgage by the Halifax with PPI
    In Dec last year he was made redundant by Virgin Atlantic from his aircrew job (thanks Richard B ) . When we went to claim on the mortgage protection we were told that unless my husband was in receipt of Job seekers allowance we were unable to claim PPI. So he went down the route of claiming job seekers allowance only to be told that his pension from the military was deemed enough for a family of five to live off (£450 per month What a joke thats how much the mortgage is !!!). Consequently we received not a single bean from the state or mortgage company. We were not eligible for anything not even free school meals for the kids. ( thats another story why is a military pension not ringfenced and how many ex servicemen are caught in the same trap We so nearly lost our home and all thanks to serving his country.). He has been a 40% tax payer for the last 10years and we were no entitled to a bean!!

    Do we have a good case to say we were missold as the mortgage company knew he was in receipt of a military pension when we applied for the mortgage and he would therefore never be eligible for Job seekers allowance?

    So sorry to hear this.

    I think you have a good case in my personal opinion, to make a reclaim on the ppi, but what you could do for better advice on this, start a new thread of your own, so it won't be missed and dunstonh is good at giving advice when it comes to mortgage ppi, not that it makes any difference on the reclaiming side of it, it should be the same.

    But keep on the ppi thread, but start a new one to yourself and maybe subject it as "mortgage ppi help".;)

    Wishing you luck with this and I'm sure this will be resolved in your favour.

    Just checking something, In my letter it says

    "as your existing loan agreement has expired (passed the date by which it should have been re-paid) my offer is to apply the compensation as follows

    £1648.26 will be used to clear your outstanding loan.
    £867.17 will be sent to you by BACS

    Now does that mean that the loan is completely settled and the £1648 was total of payments missed (which there were a few) and subsequent interest?

    I'll ring them on Monday but would like a definite answer!

    I'm inclined to say that it is but anyone else?

  • Having heard Martin speaking about this a few weeks ago I researched the site for the letters and read on this thread that someone had emailed Egg through their account. Having an Egg loan which we now know had the insurance mis-sold to us, we were told that we could not have the loan if we did not take out the insurance, I emailed them. I printed off the letters to send them to back it up but they immediately replied via email saying that this would be my complaint letter and they would confirm the complain by letter within 5 days, which they did. That was about 2 weeks ago. Today we got a letter saying that they did not agree that we had a complaint but that as a gesture of goodwill they would repay us the amount of insurance and all the payments we have been making monthly. £3850. You can imagine how delighted we are, its an amazing amount of money for us and we are just so grateful to Martin and the posters here for the inspiration. We know its our money but they would have kept it but you you. Thank you so so much :T

    After reading all the success stories I decided to try making a claim. I requested copies of paperwork about my loans from Lloyds bank. They sent these back and I used the online form to request a refund telling them I thought I had been missold insurance. Sent the letter by recorded delivery and just over a week later I have recieved an offer of a refund of all insurance payments made so far plus 8% interest. I am just waiting to hear about one other loan I had with them. It was really easy so dont be put off. Thank you so much Martin for encouraging people to go ahead and do it
