PPI Reclaiming successes and failures

Hi all
I had a loan and gredit card with egg within the last 6 years which has now been paid. I have requested my paperwork from but them ,only for them to respond that as the loan has been repaid I no longer have the right to request this information under section 78 of the Consumer Credit Act. Has anybody else come across this problem? Any advice gratefully received

Hi Julie
If you requested this as a Subject Access Request (SAR) they must by DPA law provide you with all they hold on the account.
Did you actually request for your info as a SAR request?
With payment of £10 cheque or postal order?

they have 40 calendar days to comply.
If you have done this and they are not dealing with it, then contact the information commissioners office (ICO).

Hi All,
Just wanted to say a big thankyou for all the encouraging storys on here etc.
After 2 Sussesful claims and 2 unssesful clams which are both with the FOS now, gotta keep trying.
Just received my response from BarclayCard, now i knew ive had the cards along time but was at most expecting 2K back but got my letter today, and they agree it was misold and are refunding.
Mastercard = £4872.71
Visa = £8986.44
Total = 13,859.15 so im over the moon.
So Keep on fighting these claims and DONT GIVE UP :beer:0 -

Just received my letter from Barclaycards ,they have refunded all my premiums with interst but are refunding it to my credit card.At first i was miffed but glad now as it will bring my balance down.Question now is i wonder if they will reduce my credit limit.Have to say not to bothered if they do.Really pleased now cause thats me got 3 out of 4 so a great big thanks esp to DI and amersall:rolleyes: Jan grocery challenge £300/£210 spent so far.I can do this:T0

PPI Claim against RBS.
Wrote to RBS (actually Lombard Direct, but same company).
A few weeks later they wrote back asking for a copy of the original letter as it had been "lost".
Re-sent the letter.
A few more weeks later they said no chance of it being mis-sold and gave me 8 pages of rubbish, and a £750 bribe if I dropped the case.
I wrote back telling them to check again as I disagree with what they said.
A couple of weeks later they wrote back saying that if I didn't have any further evidence then they can't look at it again.
Filed complaint with Ombudsman.
It's taken around a year already and I haven't heard from the bank yet but I spoke to the Ombudsman yesterday who confirmed that both him and RBS saw the claim as valid so it went in my favour. Now waiting for the bank to work out the money they owe, send it to the ombudsman, me to check and agree etc...
However, if someone can help I would be very grateful. How much should I be getting back if the premium was £6,541.79 over 84 months. It's 60 months in to the policy. The loan is frontloaded and they basically added the £6,541.79 to the £16,000 I wanted totalling £22,541.79 (£27,861.12 inc interest at 6.4% APR)Rich0 -

After sending several emails yesterday and today to A&L (even sent one last week to the boss of Santander!) and phoning every day since last week trying to find out what's happening with my case, have just received a call from A&L telling me the cheque is being sent out today!! I was quite stunned as I wasn't expecting that! Yesterday they couldn't tell me anything, today it's being sent!
I'd advise everyone to keep on at the banks and don't let them fob you off!
I'm so grateful to Martin for all his advice on this website, and also to everyone who's posted here, who gave me the incentive to have a go at claiming and also the helpful advice received, especially from Di and Halphy. I'm now going to be £3k better off which is a great relief, as my circumstances could be changing soon with regards to my job. Good luck to everyone!0
