    I would be inclined to write back anyway and if your reasons were the same on all, then they obviously not investigated properly, I would therefore make them aware that you don't believe these actual complaints were investigated properly because you have the same reasons for all, (if that was the case) and make them aware that you are aware the FSA are punishing banks for not investigating complaints properly and for rejecting genuine complaints.

    Ask them to reconsider by giving them 7-14 day max, or you will complain to the FOS and also request for further redress for the distress and inconvenience.
    (Even if it was the final decision).

    It is known that sometimes they do even change a final decision within good reason, good luck and keep at them.;)
    thanks for yr reply.... i will let you know what the letter says, hopefully receive it tomorrow they said? i wrote a post on page 510 regarding my loans.co.uk one. now they r upholding my account and said they will refund me all premiums paid of 4050.00 plus interest plus the 8% so thats good.... but dont know exact figure yet..... will they restructure my loan too then.. g e money financed it??? thanks again

    and not a problem.

    Good amount via loans.co.uk Congratulations.:beer:
    Remember the interest adds up as well.

    They all vary in how they refund, but just as long as there are no arrears/missed payments, you should receive all money directly back to you in forms of a cheque payment, and your loan should in my opinion be reduced monthly repayments.;)

    I had exactly same letter from Hsbc. My ppi is still running and when I've asked to cancel they said I've got to take out a new loan to repay old one. I've written back to them saying I'd already been told I wouldn't get loan without ppi so cancelling in the 30 days wasn't an option. I've also sent off to fos so will let you know if I hear anything

    hi there on the two hsbc upheld for me i too had to take out new loan but just make sure its at the interest rate u had priginally, as wen they first did it with me the interest rate was what it is nowadays which made my paymenta higher,,, when i questioned it they agreed to do it at the rate it was when i took out the loan originally..........

    they did say they would send money out via cheque to me as never claimed and no arrears but they havnt mentioned restructuring the loan,,,, do i mention this to them and if so who to.... loans.co.uk or the ppl that financed the loan??? its all confusing is this. this site is tops.. i got 1400 bk from blackhorse plus 2000 off my loan two refunds from hsbc and now the one from loans .co.uk thanks very much mse

    Yes I would definately ask them about this, because realistically it should be restructed and reduced now.
    They will have to confirm this to you, but keep a check on your monthly payments as well, any problem we will get a letter together.;)

    Sometimes they provide the recordings free of charge but another way would be to request an Subject Access Request, in short known as a SAR.
    If you request for a SAR, they should send all info held on the account, and they have 40 calendar days to do so, with an enclosed payment of £10 cheque or postal order.

    If they cannot provide the disc recordings, they must therefore then have this in written transcripts.....which should be enclosed within the SAR.


    I got the SAR today and upon investigating Vanquis are stating that they do not charge for PPI bit for ROP (repayment Option plan), and that my wife agreed to this when she activated the credit card.

    a couple of points that I have noticed though.
    1) In their letter they claim my wife activated the card 0n 9th October 2006 but in the SAR there is no entry for this date as the account was started in Oct 2007.
    2) The SAR had entries for life insurance and insurance which has been crossed out and handwritten as ROP
    3) There is no charge between 2006 and 2008 for ROP only for 2009 and 2010

    I will keep you informed as I have requested the ROP be repaid and sent the 2nd template letter

    I am in exactly the same position with Marks and Spencer's money with a charge card from 1995 and a personal reserve from 1999. I have chased via the templates since February and M and S have sent me their final stance..a big fat no....I have written to the FOS and they have said they cannot help as M and S were not covered by them at the time and nor where they covered by the GISC.
    I have called Allianz who may have been the underwriters at the time and they have no record of me, but they were not very sure of anything and after 2 hours on the phone I could not find what department to speak to.
    So I requested the underwriters info from M and S and after 4 weeks I have a reply...Cornhill Insurance and at the same time I requested the ammount of PPI paid. M and S would only give me the info from 1994 onwards so I have paid £500 and $900 on both accounts. Now my issue is that Cornhill is a subsidiary of Allianz now so does anyone know what address I would need to write to with regards to this.

    Got an answer from Allianz today stating to go back to M and S and claim from them as they sold the policy. As M and S and the FOS have both sent back my claim due to not being regulated when the policies were taken out I am in a bit of limbo now.. I have sent the 2nd letter to allianz requesting they relook at my claim but I am not holding my breath

    Hi everyone,
    It appears I spoke too soon. Yesterday the lady on the phone told me £9333.53 was in the process of being transferred to my current account, and should arrive within 3 days. i presume she must have been on a work experience day!
    Got my breakdown letter today which stated I would get roughly £6400 and £2000 to be taken off my current loan which does NOT amount to £9000. I telephoned them and purposely didn't quote the £9000 initially. The lady today confirmed the amounts in the letter, so I presume the lady yesterday made a major mistake and basically managed to get me hopeful only to crush me.
    I do appreciate that it is still a large amount of money but to be told one figure then given a smaller one is just cruel. Plus I would rather spend the money on what I wish to not what the Bank dictates. She obviously made a major mistake.
    To top it all they gave me that godawful figure of up to 21 days YET AGAIN! So far they have said up to 21 days to open my returned letters, up to 21 days to calculate my claim, and now up to 21 days to refund me. Surely in this day and age it doesn't take 21 days to conduct a Bank transaction. I presume that people like Alex Ferguson are not willing to wait 21 days for transfer money to appear in their Bank Account!
    Anyway I telephoned my branch to give them a piece of my mind. I informed them that the Armed Forces department had sold me loan insurance a total of seven times knowing full well that I would not be paid out in the case of illness or serious injury. I told them that my mortgage advisor sold me 3 home separate home insurance policies that amounted to £60 that I could have got a hell of a lot cheaper in one policy, and I told them that when I got my premier account that nobody in my branch bothered to tell me to cancel my home emergency cover as it was free with my card. Her answer was that I should have read the policies more thoroughly. I admitted I am fairly naive about money and find it hard to understand Bank lingo as it's so convoluted and confusing, but I think she was taking the P**s a bit! Anyway moral of the story - Avoid Lloyds. At least they are helping me to pay off my loan quickly because I will be working extremely hard to rid myself of any debt with them and switch accounts. I cannot trust them at all! I asked if there was someone in authority that could at least phone the insurance company and try and hurry the refund and she said she would - the woman who just said if I had been blown up in Iraq and not had my loan paid off it was my fault!
    Absolutely useless, unsympathetic, unethical (they actually recruit Armed Forces personnel in basic training with the promise of looking after us), and ridiculously slow in dealing with complaints. I urge everyone on here who has a Lloyds account to double check , and scrutinise everything they have ever purchased from them, and if you spot a discrepancy - TAKE THEM TO THE CLEANERS!
