    koe_182,

No I think you misunderstand. This is a deliberate ploy. They intentionally allocate a number they know is already used by someone else on the network. The network told me this. Then the network say that is why your mobile is not working as delivered to you, and they will have to give you a different number. Then mobiles2yourdoor claim that you have cancelled your contract, although you are still connected on the number allocated by the network. Under their terms and conditions if you did disconnect they could keep the £1 deposit and not send you the incentive gift. This is the scam they attempt.

The key question is, if the network know that they are deliberately doing this, why do they allow this charlatan distributor to continue to be their agent? This clearly contravenes the new Ofcom code.

Part of the Furniture Combo Breaker
notice that they haven't filed accounts at companies house yet - so unlikely to have been trading for 2 years. being part of p4u group does not necessarily mean they'll bail them out. also 1st cash back after 6 months rather than the usual 3-4 months. does not smell right....

Mobiles2YourDoor is a trading division of Phones 4u Ltd - Phones 4u House, Ore Close, Lymedale Business Park, Newcastle-under-Lyme, Staffordshire, ST5 9QD. Registered No 3154198. VAT No GB 823 8249 20

So same company and would be obliged to bail out any issues.

  • Phones4U is an abysmal company from all accounts; Mobiles2yourdoor seems keen to follow in the same vein. They may be unlikely to go bust, but I think you're likely to have to spend a LOT of time and apply the appropriate force to see any of your cashbacks. However, I am willing to see how things go - just in case I am willing to give this lot a punt. Not too likely right now though!

Yeah I've bought a phone from them recently - only taking a punt on their size making it more likely to get a legal recovery should the need arise. So far they are not impressing me - no vouchers received.

Yeah me too, got phone on 28/08/2007 and still waiting for vouchers.
Sent 4 e-mails inquiring and guess what, no reply to any of them.
Be good to the young on their way up you might need them on your way down.

I'm going to send a letter saying if I don't get a reply with the vouchers within 14 days (time being of the essence) then they are in breach of their own Ts & Cs.

If they then don't respond, it's good cause to do a moneyclaim for the full cashback amount. Any comments? Would this be considered vexatious?

A moneyclaim can only be made when someone owes you some money.

    Is this what has happened?

Well, they will be owing me some money when it's time to claim.

But by not issuing the vouchers as they said they would (within 14 days of purchase) and not responding to emails where I asked for them, does that not mean they are preventing me from claiming by the correct procedure, and therefore they are in breach of their own Ts & Cs?

Does that give rise to being able to claim the cashback now? I don't know!
