    If you got court papers why would you not go to court?

    loads of reasons

    if it is discontinued

    if its struck out my the judge

    if the claimant doesnt pay the filing fee

    if mediation is chosen

    if the judge directs it go to popla for ADR (prior to any court date)

    probably others I cannot think of right now

    an actual court appearance is the last resort, many paperwork hurdles come before a court appearance and so many dont get as far as an actual court appearance
  • Oh thanks for that and good to know after 6 years is cancelled by default too.

    I have just had a call from my parents telling me they had a call from them again but they missed it and did 1471 and it was Rossendale's number however it also said it was a Malicious call and it has been logged which I found rather amusing as they haven't blocked the number.

    Thanks again to everyone for all your help on this matter I am sorry if I am getting things wrong I just like to clarify things and ensure I have all the facts correct when its all new to me.

    there are dozens more that were struck out before court or in court , some redirected to popla and won , some won in court , some where the claimant didnt turn up so claim struck out, some gone to mediation by both parties , all sorts of different stories and outcomes

    even the Beavis case which went to court, lost , and went to Court of Appeal , now awaiting the decision (maybe next week)

    Parking companies rely on the general public not knowing the legal system and either messing up or chickening out.

    A brief synopsis. They file a claim. You acknowledge and file a defence. They may file a reply to defence. They decide to continue. You get a form to fill in (directions questionnaire) which for our purposes mainly just says which court location you prefer. A judge sets a hearing date. You both file final witness statements, skeleton arguments and evidence. The hearing happens.

    You can mess up at any stage, but so can they (and sadly so can the court).

  • Update on this.

    I now have another letter stating:

    PAYMENT OVERDUE - PLEASE READ THIS NOTICE CAREFULLY

    Please note that this is our final demand for payment in respect for the above detailed debt.

    You have failed to respond to our previous letter. This may now result in :-

    A doorstep collector being instructed to visit your property to collect payment; or
    A commencement of legal proceedings against you. If legal proceedings are issued and a judgement or a decree is obtained against you, court fees and legal costs could significantly increase the amount you owe.

    Once registered a judggement/decree will remain on your credit file for 6 years and may seriously affect your ability to obtain credit in the future.

    Call us now....

    PAYMENT DUE BEFORE 4th May 2015

    Now as someone has said in this thread already (red x I think?) if they award against me and I settle within 28 days nothing goes on my credit record. I think that was correct so I presume that line is incorrect.

    My dad has rang them telling them that they are harassing him and that legal action will be taken against them if they continue contacting him or receive any more letters from their company to his address. The person he spoke to said that they wouldn't be sending any bailiffs around to the house and a letter has probably already been sent so they may get that one. The letter says that its a FINAL demand so what else are they going to send me?

    They asked if they knew my address and he said he didn't know so that should be the end of that for them hopefully after this other letter comes through the door if it exists. So I presume they will just pass it back to Excel for them to deal with?

    First golden rule - NEVER, NEVER, EVER phone a debt collector. They've dealt with all the abuse and threats of legal action at a far higher level than your well-meaning Dad could even hope to deliver. I don't think he will have done you any favours there.

    Second golden rule - IGNORE, IGNORE, IGNORE debt collectors, only the PPC has any prospect of commencing legal action.

    By the way, is your doorstep well cemented in?
