  • The ad whose offer I took up had no 14-day trial period as I would not have taken it up if it had. Because nothing like this works in 14 days

All one had to do was subscribe to the newsletter at £0.29p and there was a negative pledge action where this could be revoked by a telephone call within 30-days

The ad I read also said while results would appears, it would take 6 months to work and if satisfied with the sample, subscribe for more at full price. of about £89.

I rang before the 30days was up to cancel and was told it was cancelled but my account was being debited.

After I notified my bank, I called them up and told them I had informed my bank and the police and I have copies of their invoices and newletter e-mails - none of which mention a 14-day trial but the newsletter e-mail does mention the 30-day period.

They tried the old I did not call routine but I said that I had the invoices and the e-mail which did not state the 14-day trial and i had called within the 30-days having a log of the call. They have got anxious said that they cancelled my subscription and nothing more will be taken out of my account. (but my bank had already initiated this) and offered me a 50% refund on the last amount they took out as full nd final compensation. i said no, i wanted the whole lot and will be taking out legal action to get the money back while the bank gets on with its action.

  • I submitted a fraud application to my credit card company. They have refund my initial 4.95 and have blocked all payments from this company. As a precaution they have reissued me the card and also told me that in future if any payment happens from this company, they will refund me. I have got an email saved from my credit card company.

On other hand, I never received the Vitahar bottle even after 22 days which is a good thing for me. If I haven't recieved, I can't return, can i? I rang up the company who said they have cancelled my future trials but have to tell them if haven't received the bottle by next 2 weeks.

I hope that this damn bottle never arrives now. If it does then going by good Conscience, will have to return it.
  • I made the mistake of signing up for the so called Vibron/Vitahar "free trial" last Saturday. Having done so, I immediately felt there was something wrong. I googled the company names and found a whole raft of complaints about their devious dealings. I immediately contacted Barclaycard, explained what had happened, cancelled my card and asked for a new one to be issued. At that time the postage and insurance costs for the free trial transactions were not showing on my account. These were 2 x £2.99 for postage and 2 x 99p for insurance. A few days later I noticed and amount in my "pending transactions". I contacted Barclaycard and they told me that they were the transactions described above. I explained what had happened and they told me not to worry as they had not yet been posted to the account and may get refused. A few days later I checked again and they have now been posted to my account. I contacted Barclaycard again and was told that as I had voluntarily given my card details to this company that because it was a recurring payment agreement I should contact the company directly to cancel it. They also said that even though I had cancelled the card the company may still be able to get the details of my new card and apply future charges though they would do their best to stop this from happening. I was not too reassured by this. I had also been made aware of a further £1 charge in my pending transactions from a company called Bluesnap Computer Software whose name appears on the Vibron emailed order acknowledgement. I have no idea what this is for. I was then put through to the Barclaycard "disputed transactions department" I went through the whole thing again. This time I was told that though nothing could be done about the existing transactions that I could be assured that this company could not get my new card details. Having had two Barclaycard employees give me contradictory information I have now emailed Barclaycard asking for confirmation of this in writing. Since then, I have, surprisingly enough been able to contact Vibron/Vitahar customer services by phone and told them I want to cancel the agreement. They assured me the recurring payment agreement would be cancelled immediately but that I must wait until the samples arrive and contact them again before Feb 19th to get an RMA number to enable me to return the samples. They did say that I am able to try the products and simply return part bottles if I wish. I asked what would happen if I didn't contact them again and they said I would be charged 50% of the cost of the samples - £47.50 x 2. I explained again that I didn't want the samples I simply wanted to cancel the entire thing but it made no difference though they did agree to extend the trial period to 25th Feb. Should the samples arrive, I will immediately be on the phone to them to see about getting them returned. It seems that what I have experienced is not unusual. Has anybody got beyond this point with any success? I will keep you all posted. Hopefully Barclaycard will be as good as their word and stop future payments and I will only be out of pocket a few quid. A small price to pay for my stupidity. I can't believe that the national press don't make more about this underhanded way of dealing. It needs stamping out.
  • Update - The products arrived and after 3 attempts I managed to get through to Brivon/Vitahar's customer services department. I told them that I had changed my mind about the trial and that I wanted RMA numbers so I could return the products. Though they tried to persuade me that I should at least try the products (that is their job after all) I stood firm and I eventually got the RMA numbers. They even confirmed them by email. I am sending the products back today by RM tracked delivery. Customer services said that I will not receive any further charges from them. Barclaycard have responded by telling me that they have noted on my account that I do not want them to pay these companies again and that they will try to ensure that this doesn't happen. However, if I do notice any charges on my account that are not immediately credited by BC that I should contact them and they will refund them. Obviously a comfort but I still find it surprising that BC cannot guarantee 100% that a charge will not sneak through even though they have cancelled/blocked my previous card and issued another with a new number. It seems that as stated by someone else earlier in this forum that it may be possible for companies to still get to the underlying account even after a card has been cancelled. Perhaps the only safe way is to close the account?
  • Even though this is a US product it is distributed from an address in Edinburgh 67-71 Polwarth Gardens.
If you ring them for a return reference number, having found a charge of £200 for the"Free Trial" of £4.95 shipping & handling for each product, they answer the phone, and when you say you want to return the goods, they hang up!
They will also automatically every 45 days your credit card so make sure you cancel the payment.

It is a scam, when you order your "trial" the agree terms and conditions box has a pre tic so you dont get asked to agree T&Cs. Granted you should always check but your only ordering trial samples for £4.99 each right (so you think). When the samples arrived I put to one side, two weeks after the order date 2 x £94.98 had been taken from my account. I read the paper work that came with the product and it says that unless I cancel they would be taking a similar amount each month "to ensure you would not run out". This is where they get you, its virtually impossible to cancel as you have to cancel and return the product within 14 days of the order date. They will not accept either without a RMA number which you can only get by calling the number they provide, I rang at least 20 times over several days by then the 14 days had expired.
I was convinced this is a scam, my banks local branch were not interested, they gave me a number for dealing with disputed payments which happened to be a call centre in the Philippines. I called and as I had "agreed" the T&Cs they could not refund me, they could not cancel further payments but would refund me if further payments were taken. They suggested I report the company to the trading standards.
I reported my card lost to prevent further payments.
I was resigned to the fact I had lost the 2 x £94.98 and annoyed for not taking more care but it could of been worse.
After stewing for a couple of days I still felt let down by my bank as in my eyes it is a scam, fraud, deception call it what you like.
On Monday of this week I rang the Financial Ombudsman, they were very helpful and took the details. On Wednesday I recieved a call from my banks Central Admin Team, they mentioned my complaint to the Ombudsman and offered me a complete refund plus a goodwill payment of £25.
The moral is follow your gut instinct and dont take no for an answer, the banks dont like to mess with the Ombudsman.
