Nutri Vitahar scam

Options
Hi. I would like to hear from anyone, who, like me,has fallen for the scam by 'Nutri Vitahar',hair products. I saw an ad on Yahoo for this company, who are marketing products for thinning hair. The offer was a months trial for £2.99,and under t&c's,you must cancel within 14 days of receiving the trial offer,or you will be charged £94.99 for the next batch.Well surprise, surprise,i didn't receive my £2.99 offer, and have now been charged the £94.99 also:mad:. Contacted Halifax,to report this unauthorized transaction, but have heard nothing. Anyone else fallen for this, and if so,what was the outcome?

Did you see this in their Terms and Conditions:
14-Day Trial Offer and Lifestyles Auto-Ship Program

With Vitahar's 14-Day Trial Program, you will receive one full bottle and you will initially be charged only a small shipping and handling fee. Your 14-day Introductory Trial Offer begins on the date of your order. If you are enjoying the product and loving the results 14 days from the date you place your order(order date), do nothing. Only then will your credit card be automatically charged 1 easy payment for the 1 trial bottle at just £94.99. This transaction will show on your billing statement as "Vitahar". If you're not satisfied with your Vitahar™ offer, contact customer care within your 14-day trial period by calling 0808-238-0020 (UK) Mon-Fri: 8AM-5PM, SAT: 9AM-1PM GMT to cancel and request a Return Merchandise Authorization (RMA) number with instructions to return the product, and you will have no further obligations.

To ensure you do not run out of Vitahar, starting in 45 days from your original order date of the introductory 14-day trial offer, and every 30 days thereafter, you'll receive a new bottle of Vitahar. The credit card you provide today will be billed the Member's Only discounted price of only £89.99 (plus a small £4.95 shipping and handling fee). As a member of our Vitahar Lifestyles Program, you are not obligated to continue. No hassles, no commitments. Cancel at any time!! Just contact customer service should you have any question.
They also have this statement in their T&Cs:
    NEGATIVE OPTION CLAUSE

I UNDERSTAND THAT THIS CONSUMER TRANSACTION INVOLVES A NEGATIVE OPTION, AND THAT I MAY BE LIABLE FOR PAYMENT OF FUTURE GOODS AND SERVICES UNDER THE TERMS OF THIS AGREEMENT FOR £94.99 FOR THE INITIAL TRIAL PACKAGE, AND £89.99 + £4.95 SHIPPING AND HANDLING PER MONTH IF I FAIL TO NOTIFY THE SUPPLIER NOT TO SUPPLY THE GOODS OR SERVICES DESCRIBED, OR FAIL TO RETURN THE PRODUCT UPON CANCELLATION.
During the signup process, on the same page that you enter your card details, you may have seen:

Rather naughty that they have pre-ticked the acceptance box, and if they were a UK company then that would probably be illegal.
  • My wife also fell for this scam.

Yesterday (25th Nov 2014), a package arrived in the post from this outfit and when she arrived home from work at around 6pm, she opened it and read the letter to find that she had been billed the £84.99.

Like the OP, she had taken them up on the 14 day trial at £2.99 on, I believe, the 10th or 11th of November.

Like the OP, the trial sample never arrived - the package she received yesterday was for the full subscription and she was charged £84.99 (on checking the bank statement, this payment came from her account on the 24th November).

Anyway, the letter said something about phoning a number in order to receive an RDA number if you wish to send back the item which, of course, my wife wanted to do but it had to wait until this morning as the lines were closed by the time my wife arrived home from work.

She attempted to ring them from work today but the line was never answered so I tried from home and I managed to get through.

I explained that we wish to return the product for a full refund and that I required an RDA Number.

The "Customer Service" chap said that this was not possible as the 14 day trial period had expired and kept quoting the "terms and conditions of the agreement".

I explained that as we had never received the trial sample for which my wife had paid £2.99 then, as far as I was concerned, they had failed to honour their side of those very same terms and conditions.

He said that we should have got in touch with the company sooner in order to let them know that the trial sample had not arrived.

Anyway, I spent a rather infuriating 20 minutes or more on the line with him and it was like talking to a brick wall.

The upshot was that they say that they have cancelled the agreement but as a gesture of goodwill (or somesuch) they would refund 50% of the purchase price and that we can "enjoy the product for half price".

Given the nature of this company, I am more inclined to send the product to a laboratory for poison tests.

I'm also not holding my breath on the refund being sent (he told me it would take 7-30 days to arrive in my wife's account - sufficiently long enough for us to be in the throes of festive celebrations and the whole thing forgotten about).

I cannot stress enough how much I believe that this company should be avoided.

On top of being caught out with the scam, I've also received an email today trying to get me to sign up to an additional newsletter, it's unclear whether my "card will be billed a very small monthly modest fee of just 29pence" So I need to call them AGAIN on Monday to ensure that this also is not taken. At this rate I think I may have to cancel my cc to stop them trying on any MORE additional scams!

Anyone else who has fallen for this needs to watch out for this one too...
(Starting in 30 days from the date of your order and every 30 days thereafter, a small separate 29p processing fee will be charged per issue (8 monthly issues) billed as “HealthNewsletter” to the same credit card you used for your original purchase of our products.)
