  • Can anyone help me? I have had a verbal offer from Natwest for the full claim which was 2 days before things were suspended for the test case...I have rung Natwest regarding the verbal offer, only to be told that my case is also on hold (despite having a verbal offer) - can they do this? and how do I get my money back now? I have read on another thread that the FSA have said that banks have to honour verbal and written offers...
  • Could anyone advise me as to what Nat West are currently doing with Bank Charge Claims...? I have sent the first letter to them as per the template on this site -listing all charges plus interest requesting they be refunded (came to around £1200!) These are all from around 2004 to mid 2006. With the Test Case etc... what can I expect to recieve from NatWest in reply to my first letter? Has anyone else sent a claim in recently?

    Any advice much appreciated.

    ^Yeah, I sent in a claim recently but the reply was that they are in court proceedings or something like and won't look into this complaint until its finished.
  • Gota reply from them today saying exactly that...two letters - one the standard template they send out to everyone and another saying that 'given the work involved in assesing your claim you will hear a response in 6-7 weeks'

    unlike all my friends' experiences, they say it is because I have applied too late, the bank has sent me this letter, saying they have taken the whole case to court, and I can do nothing but wait. my girlfriend says she has got someone at work who has got the same letter, but she just kept calling and moaning, and finally got to speak to the branch manager, and got her money back.Is this really effective? cos if I call, I wouldn't know what to say if they bombard me with all the legal clauses. What shall I do????????

    We acknowledge receipt of your complaint about bank charges. We believe that your complaint concerns the level, fairness or lawfulness of the charges. If it concerns something else, such as an administrative error, please let us know.
    We believe the charges are fair, transparent and lawful.
    However, the bank (along with a number of other banks) has now become involved in legal proceedings with the Office of Fair Trading ("OFT") in relation to bank charges which we believe will resolve the legal issues regarding the fairness and legality of your bank charges.
    It would be our normal approach to resolve your complaint through our internal complaints process as quickly as possible. However, until the determination of the legal issues in the above proceedings, we have asked the Financial Services Authority ("FSA") to suspend the normal timetable for dealing with bank charges complaints, and the FSA has agreed to this request subject to conditions that protect your rights.
    We can assure you we have registered and stored your complaint. Please retain your bank records, as this will make it easier for you to support your complaint on resolution of the test case.
    Once the legal proceedings between the OFT and the banks finish, we will resolve your complaint as quickly as possible.

    We are sorry that we have not been able to respond in full to your complaint now, but we (together with the FSA and the OFT) think that it is necessary to resolve the key legal issues before we decide how we should respond to your complaint.
    Obviously exactly what will happen next will depend on the courts. We do not know how long the case will take - we have promised to proceed as quickly as possible but inevitably given the importance of the issues being considered this may take many months to finally resolve. But we can assure you that once the legal proceedings are completed we will resolve your complaint as quickly as possible. If at that stage you do not agree with our conclusions you will of course be able to refer your case to the Financial Ombudsman Service ("FOS") (or to the courts). .
    Given this court case we have asked both the FOS and the courts not to proceed with any other case they are hearing until the test case is resolved. FOS has indicated that as a general proposition it will indeed not proceed with cases which rely on the legal issues being considered in the test case.
    Similarly, you should be aware that if you choose to issue a claim in the County Courts, "the Master of the Rolls" (in England & Wales) or "The Lord Chief Justice" (in Northern Ireland) has, at our request, issued a notification to the County Courts suggesting they stay proceedings about bank charges until resolution of the banks' proceedings with the OFT. Alternatively the bank will immediately apply to the Court for an order to stay your action until resolution of the bank's proceedings with the OFT.
    We will keep you updated appropriately about the proceedings with the OFT. You can also check the latest position on our website at htlo://www.natwest.com/overdraftcharaesuDdate
    The FSA requires us to ensure that your complaint will not be adversely affected by the delay in dealing with it. Customers for whom Scotland is the most likely jurisdiction should be particularly aware of the following:
    1. You may choose to take your complaint or claim against us to either the FOS or the courts in Scotland.
    2. Your right to refer your complaint to the FOS will not be affected. The FOS provides a convenient alternative to the courts, and is free for consumers. However, as already explained, you should be aware that the FOS has, at our request, decided not to determine these complaints for the time being until the test case is resolved.
    3. However, if you nonetheless wish to take your claim to the courts in Scotland, you should be aware that the timing of when you raise a claim against us may be important. As such, ~ou may wish to seek independent advice on filing a claim now to protect your ,rights (although you will have to pay a court fee). If you do this, you should be aware that the bank will immediately apply to the court to put your action on hold until the resolution of the bank's legal proceedings with the OFT.

    I can see success stories but not failures... does that sum it up?

    I sent off a reclaim letter yesterday to Natwest for £280 (not bothering about interest)... I've read that they uually reply with 'we'll get back to you 6-8weeks' but it's worth it..

    The natwest thread is a few too many hundered pages to scroll through to see if anyone has failed..

    Took out loan in March 2003 and didn't really get an explanation of what we were signing for.

    Sent our first letter in September 2007 claiming unfair PPI. Got a response a couple of weeks later saying that they disagreed as they felt the policy hadn't been mis-sold but if we were unhappy with their findings we could refer it to the Financial Ombudsman.

    We sent a 2nd letter back asking for a copy of the PPI agreement and terms & conditions as we were going to contact the Financial Ombudsman and that we also wanted to cancel any future PPI.

    Today we received a letter saying that they had cancelled all further PPI's and that they couldn't locate the paperwork that we had requested, so were therefore refunding all 57 monthly premiums @£63.06 per month totalling nearly £3600 + interest.:T :T :T :T :T

    So we'd like to say a big thankyou to Martin as this is the 3rd success story for us so far having already received £75 plus interest from the Woolwich and £300 for the Birmingham Midshires for mortgage fees.

    Any help on this situation would be appreciated.....:confused:

    I sent a letter to all 3 of my credit cards, with a cheque for £10 as suggested for a copy of all charges over the last 6 years. I have had a reply from both Capital One and Halifax. An offer from Capital One that I have refused and asked for the full amount, Halifax have kindly got in touch and said that they are dealing with my request and will send the information as soon as possible (I wonder why they're so busy?)........

    However back to Natwest......

    Letter 1 sent 11/10/2007 - requesting list of charges

    Letter dated 23/10/2007 sent back from Natwest saying that the £10 cheque was not sufficient to cover my minimum payment and that I have defaulted and may be asked to pay the full amount if this situation is not dealt with promptly.......

    In the same post came a letter from Natwest explaining how they were sorry about the fact that I am upset about the charges and as a goodwill offer heres £176.96 with no mention of the list of charges as requested and paid for..... as the cheque has been cashed (as payment for my credit card bill) even though the cheque acompanied the letter asking for the list of charges.

    I phoned Natwest and explained that I had already made a monthly payment and that the cheque was sent with a letter explaining what the £10 was meant for. I was told that the matter was in hand and that it would be sorted. I have recieved this months credit card statement and there it is a payment of £10 with my cheque..........:mad:

    They have now got less than a week until the 40 days are up should I chase it up further or wait until they run over 40 days?

    Please help if you have dealt with Natwest in the past or having the same struggle or simply know what I should do next...... thanks
