wrote to lloyds tsb on the 26th january with the list of bank charges i was claiming back , also stated i was experiencing financial difficulties due to rtha bank taking charges out my benefits..... Was not expecting to hear anything till after the court case had ended then to day i recieved a letter from Andover , customer service recovery centre
it stated.....I am just writing to let you know that we have recieved your complaint- and to say how sorry i am to learn that you feel you have cause to complain.
We expect our enquiries to be completed within the next four weeks but we will try to get our response to you sooner if we can. if theres a delay we will let you know why and we'll give you an idea of when you can expect to recieve a full response to your complaint. i hope we can sort things out for you.
In the meantime attached to this letter is a document......

    continues to state
If your compliant is about the level, fairness or lawfulness of overdraft bank charges, then a different process that weve agreed with the finacncial services authority will apply. we will write to you shortly to explain how we'll handle that compliant and what steps we will take to protect your rights. in responding to you we will also consider all the things you have raised in your letter, as well as any further information we have about your financial circumstances

So is what does this letter mean regarding my claim.... do i still give them the 14 days i said in my previous letter?
  • I am considering claiming back bank charges from lloyds and also am looking at claiming on ppi from loans I have had from lloyds over the years.

I also had car finance at one point with black horse but no longer seem to have any of the peperwork. I rang lloyds last week and they said the loans dept would have details of loans going back to 2000 otherwise I could find details on my credit report. How far back do credit reports go?

We have a 650 od which we currently go into each month. i am nervous of putting in a claim for charges if they may suddenly demand that we repay this.

I am also unsure of which line of misselling to go down with ppi. I've read Martin's thread but am still uncertain.

    Can anyone help please?

    Thanks

  • Hello - New to this site forum!
    18 months ago I succesfully claimed back £1700 from Barclays - Whoopee!!:j

But tackling Lloyds is not so straightforward especially with this investigation going on.
I need to check about what to do - as last year (June/July) I sent my two prelim letters - the last one suggesting I would pursue with court action, and then I didn't pursue it further. I would still like to reclaim - but am not sure as to which stage I'm at, and how Lloyds cases are generally doing. I also need to change my original amount.

Does anyone out there have any suggestions? Thanks so much.

If you haven't done so, I would read the Reclaim Guide and ascertain which stage your claim is at.

You should also read the update, in which Martin tells you how the current Test Case may affect your claim.

  • Thanks nickmack - I think I know which stage my claim is at - basically I am due to file in court to start with legal proceedings. But I'm not sure if I can go ahead with this becasue of the 8 month delay since my last letter. ???
The forums seem to suggest its better to get claims going in this waiting period - can i consider my claim to be in process?
And should I take the next step and file with my local court???

sorry if I'm not getting it clear!

If it's been 8 months since the last letter, it would be a good idea to send another letter before filing. They probably think you have given up, so this will let them know otherwise.

If you've sent the letters off already and tried to resolve it out of court, then you can file the claim.

An additional letter is out of courtesy because it's been several months and should provide a final chance for the bank to settle. It should also help prevent them complaining to the judge that you have not tried to sort this out without a court claim.

Of course when you file your claim, it's likely to be stayed pending the outcome of the Test Case, but it's then in the 'system' as it were.
  • Hi all,

Just registered to ask a question of my own. I have successfully claimed my charges back from HSBC many months ago but now we hae a different issue with my partner's bank. She has now had a letter from Lloyds saying she has an overdraft fee of about 30 quid but there is also a DAILY charge of £20. As we will e overdrawn until we next get paid I have worked out that the charges in total will amount to about £300...where do we stand with the bank about this as we are furious and would like this one nipped in the bud as soon as possible without going down the courts route again??

    Thanks all!!
