  • You can claim bank charges back although the bank may well tell you that they will be awaiting the outcome of the OFT test case due to start next week.

    Hi All
    Happy New Year

    Finely an update to my case against lloyds
    I have had a letter regarding my stay I have a court hearing set for 18th january to decide if the stay should be lifted on grounds of hardship.

    Does anyone have any idea what I have to do now?

    What do I need to take with me to court?
    Do i need my full bundle?

    Any and all suggestions gratefully accepted





    AN UPDATE TO ABOVE POST 740 FROM 2ND JAN

    OK so I still can't find the letter from the court, You know what happens ,you put things away safely, So safely even you can't find them.
    Anyways , today I received a letter from SCaM which is a skeleton argument for the hearing. They have completely ignored the fact that I asked for the stay to be lifted because of hardship and the argument just goes on about the test case.

    Does anyone think that I should call them and remind them of that ( I did copy them in when I wrote to the court and sent it ecorded delivery, They did get it) or what does anyone think I should do or take with me to court??

    ANY AND ALL ADVICE GRATEFULLY RECEIVED!!!

    There may be somebody else who comes along, but this should start you off:

    Remember that all along the clain is not for unfair bank charges, but financial hardship becoz of charges

    Bacisally you need to produce bundles for the court - 1 for you, 1 for the judge and 1 for the other side, these are the documents you intend to rely on in court.
    they would include letters from bank stating charges
    your letters back (if any)
    a copy of your SOA (statement of affairs)
    Any action you have had to take as a result of the chargesm ie - have you had to borrow off anyone.

    Proof that the other side have recieved the letters etc off you,(print off the proof fo delievery from Royal Mail website)

    As for the other side, there not going to listen to you re the case being lifted as it is in there best interests for the case to be stayed, otherwise a new floodgate may be opened (the financial hardship)

    I would just give the financial obsbumnen a ring, as they may be able to suggest further.

    Income Support, Child Benefit, DLA and Tax Credits:(you would list each one seperately, as to whether you got paid weekly, monthly etc, if weekly x 4 to make a month)

    credit cards £250 (list each payment seperately)

    Car bills £25
    Home bills £100
    Holidays £50.00
    Odds and sods £60

    Total £788

    Account for every pound going out, everybodies SOA different, council tax, rent, mortage, elec, gas, food, water rates
    Debts

    Credit Cards (breakdown of figures)

    Card 1- £xx.xx (amount owing) (what your trying to pay)

    Overdraft

    Open uni £575 -9% apr -Minimum of £50.00 month repay Dec 08

    Overdraft £1000 - 15% apr - £50.00 per month - Dec09

    Club £45.00 (!5.00 mth - 3 months)
    Club account 2 (55.00 - 2 months £27.00)

    Then add up all your outgoings - hopefully there should not be a negative figure.

  • I feel i have to write about the dreadful customer service I've been receiving through Lloyds TSB Card Services. I wrote to them back in August requesting statements for a closed mastercard and a current visa card account (since paid and closed).
    Firstly after the 40 day period I received statements for the Visa but not the Mastercard as also requested. I phoned in and was told it couldn't be found on the system but would be looked in to. Anyway after numerous phonecalls I ended up receiving a further 2 batches of VISA statements over the next 3 months. IVE STILL RECEIVED NO MASTERCARD STATEMENTS AS OF TODAY.
    I spoke to a really helpful girl at the beginning of this week called Lee at the phonebanking department who found the card number within 2 minutes and also held the line whilst I spoke to the department she transferred me to. They were very rude which I've had to endure every time I've called. Although I've been very polite they are just not interested in helping. Thankfully Lee witnessed this and was as appalled as me.
    I called today for an update and they have no record of this call and can't find the card again!!! It's astounding. A new girl today has given me 2 names. herself and her line manager and she is faxing the department with an urgent request.
    I've asked for a refund of phonecalls and for the charges on my VISA that I had requested in November to be refunded and sorted out. I just want to highlight how utterly disorganised and unhelpful I've found Lloyds. I hate to think how many people they treat like this in a day. I for one won't hold my breath. I'm going to the FOS now.

    I had a similar problem with Lloyds TSB card services. Asked for my visa statements back in May 2007 (sent the letter recorded delivery and with a cheque) once the 40 days passed and no statements i rung them and they stated they hadn't recieved it. Took this matter to the Information commisioner who then told me to make a formal complaint to Lloyds card services who promptly did nothing. In October I went back to the Information Commisioner and dispite weekly phone calls to them I have recieved no come back or my statements and I get the monthly letter saying my case is being reviewed.

    Unfortunately I no longer have faith with either the FOS or the information commision any more as it is obvious to me that they are as corrupt as the government they work for.

    Best cure for your Lloyds TSB problems....CHANGE BANK
