    Hi
    I recieved a letter this morning informing me I am £28.06 overdrawn on my current account. I have transfered money from my student account to cover the overdraft and the fees they are charging me.
    I want to know if I can claim the fees back. I don't know much about it and since reading the guide on MSE I am unsure whether I can.
    They are charging me £15 monthly unplanned overdraft fee plus a daily fee of £15.00. They are also charging me £20 because a standing order I had set up couldn't be paid.
    I don't know if I can claim. I went overdrawn on the 6th November, the letter was dated the 7th and the I recieved it this morning, the 8th.
    I would appreciate your help

    Yes you can reclaim its just a case of starting the whole business with letters 1 & 2 and then starting court proceedings, I've included a link which will take you to the reclaim threads, which tell you what to do

    yes, because if it is under a certain amount there is no court fee, so they are likely to make you an offer.
  • My boyfriend just called up Lloyds TSB to request credit card statements and was told that it would cost £6 per month per statement!!!!!!!! Can they do this???? Is it better to just write???? 40 days to respond seems like a very long time and requesting it on the phone seems much easier.

    Has anyone experienced this? Has anyone won their money back? Any info would be much appreciated especially as I'm feeling a bit disheartened!

    we are currently claiming for 3 lloyds accounts, my sole, oh sole and 1 joint.

    sent three letters asking for charges back about 3 months ago got a letter telling me to sod off.. then couple of weeks ago i got another talking about the test case..

    what should i be doing now???

    also charges have increased since first letter does this matter

    please help im going mad trying to figure it out!

    I called LTSB as the 40 days were up on the 16/10/07. On the 1st of November when I still hadn't received them I spoke to CARD SERVICES on 0845 606 2171 who told me they'd been incorrectly sent out and would re-send.
    Still waiting although I was told by telephone today I should receive them anyday now. What I'd like to know is timescales? An earlier complaint with LTSB took 5mths and I ended up gaining settlement through the FOS. That was for bank charges.Take it they have not improved their customer Service since then:rolleyes:

    My girlfriend wrote to Lloyds TSB back in July (2nd Letter) but never sent the 3rd and final letter giving them 14days before starting the court claim.

    Should she send the thrid letter now and maybe issue the court claim. even though it will be stayed for the near future, is it worth getting the claim in now so it will be dealt with once the test case has been completed?

    Hi,

    I'm new to posting but not new to the site, here's my question:

    I have an overdraft limit of £1900. A direct debit took me over my limit on the 20th November, then today (22nd) I received a letter from my bank to say that they were going to charge me a monthly fee of £15 for an unplanned overdraft, plus £15 for each day I was over the limit. So in total I'm being charged £45.

    I rang the bank and politely asked if the charge could be waivered as I was only over the limit for 2 days (I got paid today), and the bank refused and said that because of the amount I was over (£37) they could not waiver the charge. She said it was my responsibility to check my balance, and that they offer a text alert service for £2.50 a month to warn me when I am near my limit! why would I pay £30 a year so that I don't get a bank charge! Or is that just me??

    This is the first charge I've had, so is it worth reclaiming, or should I just learn from it?

  • To benefit from the waiver in dealing with complaints about bank charges, the banks that are party to the test case must comply with certain conditions to benefit from the waiver.

    The conditions can be seen on the FSA web site here

    I believe LloydsTSB are not complying with at least one of the conditions and so we should all complain to the FSA and get LloydsTSB to sort themselves out or lose the benefit of the waiver.

    On 2/11/07 LloydsTSB increased there unauthorised o/d charge from £30 per incident plus £30 each day the o/d increases to £20 per day to a maximum of 10 charges per month. So if you have an unauthorised o/d that didn't increase Lloyds would have charged £30 wheras since 2/11 that has increased to £200 per month!!!!

    This is in breach of condition 13(2) that states:

    "Whilst this direction is in force, the firm has agreed with the FSA to have regard to its obligations under the general law and the Banking Code relating to relevant charges complaints. In particular, the firm has agreed with the FSA that it will not:
    (a) make materially adverse changes in the level of its unauthorised overdraft charges (or in the ways that it applies such charges to its customers' accounts) which could amount to customer abuse; or..."
