I would like some advise if possible. I got a letter from Lloyds bank saying they were not going to pay me my charges and also sent me a form to contact the Financial Ombudsman.
I looked at Martins guide once again and started to fill out a small claims form on HMCS.
It looks like there is a £70 charge for doing this.
As the courts are now looking into the banks claims is it still advisable to go ahead and carry on my claim as Lloyds have said that if they dont hear from me then they will believe its the end of my claim?

Thats a bob standard letter all of us as Lloyds customers have received...this is merely a put you off tactic, unfortunately there is a fee payable depending on the size of your claim and it is payable at the time of issuing proceedings, this is however refundable should you win your case, at the moment alot of claimers are still issuing claims and paying fees in order not to get time barred or merely just to get their claim in the system, your claim will be stayed until the resolution of the OFT test case, once an amount has been set for banks to lawfully charge you will have your remainder refunded aswell as your fee...In any case you will eventually have to claim in the same manner as alot of us have already should the result be favourable.0

I didn't think I'd be posting this, given the effect the test case has had in delaying so many of our claims, but I'm delighted to say that I got my bank charges refunded in full (bar the interest, but since we weren't at court not surprising, really) by Lloyds yesterday as a 'goodwill gesture'.

Many, many thanks to everyone on here who helped - to Martin for his guides and templates, and to all the people who answered questions, supplied email addresses, hints and tips etc etc.
Anyone who has followed my (somewhat sporadic) posts will know that my claim wasn't run of the mill, in that I'd had a number of quite serious customer service issues that complicated things considerably and I'd begun to give up hope of ever coming out on top. This is proof that, even in the current climate with the test case pending, if you have good grounds for complaint (serious financial hardship, bank contributing to account mismanagement etc) you do still have a chance of getting your money back.
I'm not quite out of the woods yet as far as recovering financially goes and there are some lesser charges that have accumulated between me filing my claim and this offer being made, but this is a really great start, I think.

From your post I feel I may be in a similar position. I have an agreed aoverdraft with LTSB but I am paying this back at £30 every month. Problem with this is when they take their £30, I go over the agreed limit and incur another £30 charge - an endless cycle!
I am pursuing my claim (as is my partner with Halifax) on the grounds of severe financial hardship.
You insinuate your claim has not been plain sailing, can you advise in what way?

Hi Daren - I began to rack up bank charges when I was made redundant - prior to that I'd had a clear account for 20 years. I had insurance and benefits that should have seen me through the jobless period, but owing to some delays processing my DWP claim, I was, through no fault of my own, without funds of any sort for a while.
I feel that the crucial points in my argument were:-
1) Lloyds had themselves contributed to the funding shortfall because they (or rather, their mortage lender) was supposed to be corresponding with the DWP to help process the insurance/benefits claim, yet kept failing to respond to requests for information causing a delay of several months.
2) The bank had shown virtually no discretion over charges, yet the banking code says help/discretion must be considered for people in financial hardship. (especially when you consider point 1!!)
On top of that, I also had some account managment issues such as funds being deducted in excess of mutually agreed payment plans, and general customer service issues such as rudeness from call centre staff etc. It would take all night to go into the details, but the crux of the matter was that, IMHO, Lloyds had significantly contributed to my financial hardship and thus I held them largely responsible for the state of my account, and the subsequent 'snowball' effect of charges.
The charges refund was a 'goodwill gesture' only - Lloyds didn't admit to most of the claims I'd made about their service, but to be honest, I'm past caring about blame, and just mightly relieved to have got back what I genuinely feel were misappropriated funds.
This has taken me 9-10 months, including an online small claims court filing, two attempts to get the stay removed, and finally a month or so of correspondence with Lloyds Head Office. In fairness I ought to mention that the more senior staff I've been dealing with over the past few weeks have been excellent - it's just a shame the lower ranks aren't a bit more customer focused, or empowered to do more.0 -

As Lloyds will more than likely defend your claim in which case it will be stayed automatically if you use MCOL whereas if you file your claim at your local court there is a chance that the court won't stay your claim. If you are claiming benefits or on low income you can also apply for exemption of fees, please read the Reclaim Help Thread for links regarding this.0 -
hi all i need some help pleases as to where to go next
i have a lloyds tsb current account and havre nbeen with them for 8 years now and i now hate them they have been chargeing me crazy amounts, i have not used this account since january when my o/d was set at 750 by feb my account went o/d by 150 this was just in charges then by aug it reached 1064 purly charges this was with me making my payments like they asked me to by there collections dept,this is done on a monthly basis untill i have paid my overdraft off compleatly, then in march i reicved a letter saying that they had set a new o/d limit to 1030 without prior coraspondance by july they did it agin and put it up to 1080 again without any corraspondance.
aug i got a statement saying my o/d was at 1064.84 and thats with me paying the 10 they agreed to, so it has made no difference waht so ever me paying them anything as its not coming off my balance.#
so yesterday i got a call from lloyds tsb say that my account is o/d by 2000.73p this i dont understand as i hae not usedthe account and have been paying them 10 a month so they telling me that the 10 is not reaching them on thedate they setit at so they re set it for a different date ut is still getting to them on time i really dont know what is the matter with these people as it is there fault i am encuring more charges.
in july aug i sent the bank charges letter that i downloaded from the bbc website a long with my statements i then recived a letter from them saying that they were not able to deal with this complaint as they were in leagal procceding with the office of fair trading in relationfairnes of the charges, and that i have to wait untill the courts have made a desion as to weather all the charges milaky is able to be reclaimed or not, so im now suckin limbo and dont know where to go or what to do as im not i any position to repay this amount other than the 10 i already pay.
please help me if you can it will be much appreciated .

I was claiming back £425, I sent the first letter, waited, nothing happened. Then I decided to send the court letter and just got a letter back saying "what will happen next depends on the courts". I now have to go through the stress of all the court business. I just knew Lloyds would be the harshest on people, anyone get the same back? Any advice? Thanks guys!0

oh yes.....am currently fighting the courts decision on a stay..due to the courts showing 'defendant bias'...dont give up.but do serve a claim thru the county court and not mcol, mcol are stayin claims with immediate effect alot of courts are too but in any event the outcome of the oft test case means you will still have to file for repayment.0
