    bailey ...go look at post 9# on the reclaim bank charges helpthread..you will have to scroll a bit on that post to find business accounts.

    I got one from Lloyds last week saying that they would be applying for a STAY. I didn't have a clue what it meant. I was supposed to be in court on Thursday this week. I got a call for a lady at our courts to say that they had received the letter and she had forwarded to the judge who had approved the STAY. This meant that I do not have to go to court until next year after the test case. I was so relieved! When I asked if she was contacting everyone, she said no. It was just because of the postal strike and that I wouldn't have got it in time and would have turned up at court and there wouldn't have been a case.

    It is worth ringing the court to ask. I don't think they will be hearing any cases until after the test case.

    Just an update. I go a call last week from a lovely lady at our local court saying thsat the bank had applied for a stay and it had been grnated by the judge. They had sent a letter informing me that there would be no court case on Thursday. She said that due to the postal srtike I wouldn't get the letter in time so she gave me a quick ring. I feel so relieved now!
  • I've received my reply from Lloyds re my claim for charges on our old business account but they're response is that they're charges were perfectly legal and thet we're not protected anyways as the account was a business account.
    Any advice? What do I do now?

    I have never used this before, so i hope im on the correct page. I wrote to Lloyds tsb asking for my money back, giving them the 2 wk deadline. They wrote back and said they were dealing with my claim, but it could take up to 4 wks, even then theres no guarantee they will get back to me in that time. Is there anything i can do as i set them a deadline for 2 wks to pay me back my money, and they have now set one for 4 wks+. Should i escalate my claim to the cour, or wait and see. Any help appreciated.

    have the defendants defaulted in any way??? I know this is a late reply to your post date, but I am writing to the Court this week about a stay applied to my claim...the good old judge in his letter stated..." after considering the papers in this claim it is Ordered the claim be stayed."...pah! he did no consideration whatsoever because if he did then he would have seen that the ruddy defence was struck out on the 20th sept and judgement applied for on 30th sept....the D***H*** judge granted the stay on 2nd October but granted permission to have the stay lifted...set aside or varied....yeah with a nice big fee to go with it, am sure they,re on the ruddy make aswell...Unfair isnt the word I,d normally use to describe an incompetant prat. :rotfl:

    hi everyone im stuck,
    ive just received a letter from the courts this morning returning the attached judgement registration for lloyds tsb for bank charges and they app need to query a piece of info i have supplied, its states that if there are any amendments i need to fill in an N244 form and pay £40,
    reasons for failure stated on the back page of the judgement registration:
    we are unable to register a firm?limited company. Please advise if the judgement relates to:
    a) limited company trading as a firm
    b) joint judgement against firm and limited company
    c) firm only
    d) limited company only
    e) firm part of address for limited company e.g accountants or solicitors
    f) other-please specify

    what do i do? they say if i cannot register the judgement then i am unable to enforce it, it does however say that if i have no further info then to state this on the form and return it, has anyone come across this?

    you need to put Lloyds Tsb Bank PLC check back on your original claim form and see what you have typed in...before you pay any fee, phone the court tomorrow and ask for advice

    thanks lindilou it does have on my claim form first defendant:lloyds tsb then underneath in the same box for the rest of the address it says lloyds tsb bank plc, charlton place etc... but i will ring the court and see what they say
