I have had no word from the bank or the solicitors since MCOL said that the case would be transferred to local court. :mad:
My partner sent his letters off 1 day after mine and he has received a letter stating that the case would go to local court and on Monday a letter from SCAM saying LLoyds were going to refund him the full amount + court costs £2555.38. I'm so happy that he has got this. :beer:
Just wondering what has happened to mine. I have tried rinign Andover with no success and SCAM said they can't do anything until Lloyds say so.:eek:0 -

I can only suggest what I did, and that was taking it to my local branch and handing it in person to a member of staff. That way they couldn't say it had been lost in the post!
It took about a week or so for my branch manager to forward it on to the relevant people.0 -

It's usually within the week, not long, keep checking your account thats what I kept doing, then nearly had a heart attack when I saw the credits there one lunch time :rotfl:

Well, My MIL's case...they didn't acknowledge within the time stated so she requested judgement on them...heard zilch. The time passed by where had they acknowledged they could have defended..again..nothing...but she's heard nothing from them. She has rung the court dealing with it but they say they havn't heard from the bank,just wait a few days (theyve said this to her a few times!)
So whats going on? Has she won??

Helen. In that case don't assume you've won. My case is well documented on this site in earlier pages, but in brief. We entered judgement by default and requested to be paid immediately. We gave it a week and there was no settlelement therefore we wrote to Andover & SC&M solicitors advising that we had won judgement by default and wanted to be paid by a date 7 days later. The day before that was up, we called the Solicitors to ask where our pay out was and that we were ready to issue a warrant. We were advised that they would be requesting judgement by default be set aside.
We spoke with the court three days later who advised that they had receioved nothing from lloyds, and so - as was our entitlement we issued a warrant for the recovery of the money. Lo and behold late last week we received notice drom MCOL (Northampton) that they had transferred the case to our local caourt as Lloyds had requested that the judgement be set aside as they supposedly never received our original claim. Which I don't believe. So we have written to the court requesting that that application to set the judgement aside be struck out and have given our reasons why. We have left the warrant in place, but are waiting to hear from our local court as to what happends next. Basicall, if Lloyds let a case slip through the net, they will pretend that they never received the original claim. So I guess that if the judge rules in their favour then we are right back to the beginning of the process again in that they will now issue a defence, and we will go back through the whole rigmarol of tryhing to fight for our money via a court process. this is of course a blatant abuse of the court process on their part.
However, I have read that the best thing to do, may be to contact the Solicitors to advise of your claim and that they haven't defended and ask wha their intentions are (which you know the answer to - DEFEND) but at least then you won't go all the way back to the beginnning of the preocess like we probably have to - in that the original claim be reserved on them, they ackowledge, then defend then all the hassle and wait for court dates etc.
I am hoping tha the judge will strike out their application and at present I am leaving the warrant to run also pending further direction from the courts.0
