    I have posted this before but no one want to talk to me:confused:

    I sent a claim to Lloyds for approx £700 and they wrote back to me saying that " the charges were for arranging higher tempory overdrafts and not default charges" ?!! I never asked them to arrange. They did not return any items unpaid, but charged me everyday the amount increased.

    Anyone tell me what this means regards my claim??<!-- / message -->

    hi u need to do mcol or go to fo, cos thats all tsb are paying out , i asked for £5,300 and got a good will jesture of £750 just havent done the mcol on line yet as i need a question answered good luck jill

    Hi Karen,
    Don't waste your time trying to ring them as they never seem to answer the phone! You have no option whether you accept it really, as they pay it into your account without waiting for your reply!

    The way I did it was to write to them stating that I would accept the offer as a partial payment without prejudice, but would be seeking the outstanding balance through the courts.

    Same thing happened to me today but before I realised the money was in my account already I sent a letter saying I didn't accept it and would be proceeding through the courts (the process has already started and I paid £80 to do so), will this be OK or should I send a second letter tomorrow saying I will accept it as partial payment?

    I have sent 3 letters, dating back to April. I've had the typical get lost letter and my reply to that was for them to send me a break down of their charges so I could understand etc and that I would settle for a lower amount. This letter was sent by myself on the 22nd of May and since then I've been to busy to follow it up.

    Yesterday I was getting things together to complain to the ombudsman but today I get another letter from Lloyds claiming that they are looking into my complain, they are very sorry for the delay and hope to have it delt with soon.

    Is this another get lost letter and should I give it another 14 days? I'm not in a hurry for this money as I never thought I'd see it again.

    We have all had that letter, give them extra time if you wish its entirely up to you, but you will find that after yet another 4 weeks they will offer you the maximum of £750 depending on size of your claim, dont expect a reply in 14 days its not going to happen, I actually responded to that letter with ' It is in my oppinion that reasonable time has been given in this matter and unless I receive a satisfactory response within 14 days of the date of this letter then I will either instigate legal proceedings or contact the FO.' and this was even after I sent the LBA..

    Write to them accepting the £750 as a partial payment and tell them you are still claiming the balance outstanding. If you have used the templates from this site to get this far then you must be at the stage were you now take court action. I used MCOL.

  • i put in claim for my bank charges with lloyds tsb for 1880. i got a letter back saying that they do not believe the charges to be unfair. so i send them martins letter to say i would take them to court that was 8 days ago and i have not heared anything . do you think they will pay or will i have to go to court and if i do i am worried i will lose????????????????????????//:eek:

    no you dont...just submit your charges...the £750 will be taken into consideration if and when it goes to court....I asked this question tonight funny enough from my solicitor friend...you do not subtract the £750 from your claim, the £750 comes off at judgement...therefore your interest will be correct to claim.

    Don't worry - keep at them! The letter saying they think the charges are fair is a standard fob-off. Give them until the fourteen days are up to respond to your court threat, then register with MCOL. I seem to remember I didn't hear anything until after I'd started proceedings with MCOL.

    Don't worry about losing... These things can drag on, but the chances are that the solicitors acting on behalf of LTSB will settle before you have to go to court. At least that's what they've done with me (and several others on here).
