Because some people can't be bothered with the whole court scenario or are scared of it, and others simply can't pay the court fees.

Received that letter yesterday and the money has appeared in my account today! Calling Andover is pointless, what do I do?

Having read some similar posts regarding this same problem it seems I should be sending a letter saying I take it as partial payment without prejudice...or something along those lines. Unfortunately before the money went in today I sent a letter this morning respectfully declining their offer as it wasn't for the full amount and also didn't take into account my already spent court fees.

    Will that be OK?
  • Quick Question to anyone (plus a positive update!)

On Friday I got the letter from SC&M informing me that they will be defending my case but seeing as they're nice people, they're going to give me my money back anyway!
However the question I have is this: Can I trust them to pay the money into my account? How long does it usually take?

The reason I ask is because I've got to hand in my AQ to my local county court before July 17th along with another hundred quid. I don't want to part with another hundred quid if I can avoid it!
The letter from SC&M did say that I had to send them a copy of the letter I send to the court cancelling the action, so should I cancel the action now and trust them to pay the money, or should I hold on to the last minute and if the money hasn't been paid in by the 16th, then pay the hundred quid with my AQ.

Any advice would be much appreciated! Almost there!!!
  • Hi,

Three months ago, I sent a letter asking for a total of £4,685 in charges (including interest) from Lloyds TSB. About 2 weeks ago I got a letter from them saying sorry for the delay but to bear with them and hopefully we could reach an amicable agreement. Great!, I thought, they are gonna make me an offer! On friday, I got a letter saying they will give me £750, which doesn't even touch they amount I am claiming for, and that it would be paid into my account within 10 days. I went to the bank yesterday, and discovered they have already credited my account with £750 before I had time to even sort out my next letter saying I am not happy with their offer! I don't want to complain coz £750 is better than nothing but I was hoping for so much more:confused: ! Now I don't know what to do, should I just say 'Oh well, I have £750 so thats that!' or pursue it, and now the bank have paid it into my account and it will no doubt be swallowed up my my daily bills etc, I am not sure what would happen if I did pursue it, like would they ask for it back?

Can anyone help? I think they have been very naughty and crafty here!

    Hi Karen,
Don't waste your time trying to ring them as they never seem to answer the phone! You have no option whether you accept it really, as they pay it into your account without waiting for your reply!

The way I did it was to write to them stating that I would accept the offer as a partial payment without prejudice, but would be seeking the outstanding balance through the courts.
    Hope this helps!
