    i put in claim for my bank charges with lloyds tsb for 1880. i got a letter back saying that they do not believe the charges to be unfair. so i send them martins letter to say i would take them to court that was 8 days ago and i have not heared anything . do you think they will pay or will i have to go to court and if i do i am worried i will lose????????????????????????//:eek:
    they are using a stalling tactic annie, but am afraid you may have to threaten the whole way with LTSB as with Barclays they are putting in quite a scare tactic, this letter is not unusual to most claimants, in fact I think the banks have their own templates to use lol, because they all seem rather familiar.

    If you haven't yet registered your claim with MCOL, then I'd simply deduct the £750 off the total claim. Don't worry about the interest etc. Whatever the total is that your claiming (including the interest), simply deduct the £750 from that.

    No dont deduct the £750 off your total claim...you claim as if you havent received the £750 or you will be doing yourself out of interest on the daily rate... and your sums will end up wrong.

    hi guys im wondering if anyone can help ive sent the letter off to lloyds threatening to take them to court if they dont give me a satisfactory response within 14 days the 14 days are up on wed and up to now i still havent heard from them what should i do if i havent heard from them by wed,do i automatically start the court proceedings or do i send them another letter asking them for my money back?

    how many letters have you sent in total and when did you start your claim, sorry if I misread but if you are at LBA and they havent responded then start your court proceedings ;)

    its up to you ive been waiting 4 weeks for my final response when i finally got through to speak to them they said another 2 weeks so i went to the financial ombudsmen then had a letter from them this morning begging me to wait another 2 weeks TO LATE like i said its up to you you are completely within your rights to take them to court to be honest i couldnt be bothered with the court bit it freakes me out abit whimp i know!
    :one day i WILL be debt free

    ive got my statements and sent them the letter to say i want the total back with interest and that i expect to recieve a reply from them within 14 days which is up on wed and up to now i havent heard anything.

    ok vicky ..they may ask you to supply a list of the charges you are claiming plus how you have calculated the interest, this is not unusual...before you even take court action or FO you need to exhaust this internally with your bank before even staking a claim..This is normally about 56 days or 8 weeks from when you first ask for your charges back.
