hey i hoping someone can help me,ive just submitted my claim online and recieved a letter to say theyve accepted the claim.ive now checked on the MCOL website to check the process and its asking me to choose a statement you may all already know what they are but just incase you dont here they are:
a)The defendant has not filed an admission or defence to my claim:
    (Judgment by Default)

You will need to decide, how and when you want the defendant to pay. You can ask for the Judgment to be paid by instalment or in one payment.
    <TABLE cellSpacing=0 cellPadding=6 width="100%" background=images/spacer.gif border=0><TBODY><TR><TD vAlign=top><TABLE cellSpacing=0 cellPadding=2 border=0><TBODY><TR><TD>b) The defendant admits that all the money is owed
    (Judgment by Admission)

If the defendant has given a new address on the form of admission to which correspondence should be sent, update the defendant's details within the following Judgment request.

im hoping someone can give me advice on which one to tick as im really not sure.your advice would be greatly appreciated.vicky

you wont be able to do anything yet claimwise
  • Just wanted to let you know that I looked online on Tuesday and to my amazement and great pleasure, my charges had been refunded - just over 4k on three accounts - yippee!

I dealt through MCOL and Lloyds did not respond to any correspondence and on 25 July (the day before the OFT test case was announced), I entered a Warrant. I spoke with the Bailiffs office last week and he was going to see Lloyds to see if he could get a cheque or remove the goods. However, he did caution that they may demand a "stay", in which case I may have waited ages.

As it happens, when i checked the account on Tuesday, the funds were there. I have had no correspondence from Lloyds, either advising of the transfer or asking me to move my account (yet).

My message to all of you still trying is keep at it - in total this took me over four months, with barely an acknowledgement from Lloyds.

Big thanks to all you guys on here for the messages and comments and to Martin for waving the flag on behalf of the little guy.:j
  • My girlfriend got charged £90 for going 80p over on her LLoyds TSB account, is it possible for her to just walk in and request them to pay it her back because its against the law? shes gonna close her account as well especially cause of the cheek, does that provide any leverage?

    Thanks

    She can ask nicely.
But its not "against the law" for the bank to charge her.
The charges will be clearly explained in the terms and conditions of the account where does cheek come into it?

Looking at their charges she must have been overdrawn on three days or more in a month and payments made on each of those days to increase the unauthorised overdraft. Their charge is £30 each day a payment is made max three days in a month

    Hi karen

firstly welcome to the the forum :D

I would say go for it. I managed to reclaim over £800 from lloydstsb this year and I didn't have to go to court.

    have a read HERE

Theres loads of info there how to go about it and what to do at each stage as well as others success stories etc.

Its not hard really and you dont need to be great at figures etc.

Like I say have a look around the forum link above and you will find inspiration and maybe some good advice from those who have more expertise at this than I do.

    Good luck

    Hi Karenw

Don't be put off about reclaiming. Everyone on this forum thoght they couldn't take on the big banks, but if you read how many people have won against them, it just inspires you to want to get YOUR money back from the banks.

Unfortunately I started my claim about 3 weeks too late, otherwise I would ahve been posting my own success story, as you can see from my signature, my charges & my wife's probably only come to half of your reclaim amount.

You should definitely carry on and go for it, for the sake of a few letters and some recorded delivery charges, and with the help of the good people on the forum, you will be glad you carried on.

Good Luck & go for it
