    I have been helping a friend reclaim her cc charges through mcol, the bank defended and today she has got a letter that it has been stayed by the court.The whole defence reads as if it's bank charges but it's cc charges. Can anybody help with the next step please.
  • HELP!

    I had judgment entered on 3 August 2007 against Lloyds for £2101.76 with payment forthwith. Lloyds had not entered a defence within the 28 days and as yet I still have not heard from Lloyds. I sent a letter asking them to pay the amount due in to my account by 17th. Nothing. Sent a fax this week saying I was disappointed they had not responded and sent copy of judgment and letter sent to my branch. Still nothing.
    Has anybody else had this problem? Any idea when I can expect to see my money? As I have had nothing from Lloyds regarding this claim, who should I call to chase it? My branch is 30+ miles away from where I work so no chance of popping in to see them and the only number I have is a call centre.

    Any help appreciated
    Lloyds (Bank a/c) £2101.76 :jCapital One claiming £933.17 inc interest Halifax Card claiming £1143.75 inc. interest - £450 accepted as part payment only
    Mint (RBS) £60 - accepted £25.85:j
    Lloyds Card - £663.18
    Barclaycard -£1951.70 inc. interest :j

    In these circumstances I would apply for a warrant of execution and ask the bailiffs to recover the judgment debt this would provoke a response.
    As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person

  • I have this morning recieved a letter from Lloyds TSB within a week of sending my details to them. It basically says...We have asked the Financial Services Authoritiy to suspend the normal timetable for dealing with bank charges complaints which relate to unauthorised overdraft fees. The FSA has agreed to this request subject to conditions that protect your rights.
    Basically, my complaint has been registered and put on hold until the problem has been resolved in the courts between the banks and the OFT.
    Do I have to sit back and wait now, or is this just another spoiling tactic?. I can email letter if it is required

    If any of you have received the £750 letter you may want to leave it at that (like my husband did), so I got him to sign and send a letter saying that it was acceptable as part payment and when we, the customer, wins the court case will expect the rest of the money to be refunded. My husband would not take it to court or try for the rest at the moment so it leaves the door open to claim the rest of it if they don't automatically put it into his account when we win.
    I'm stressed enough over this - please don't add to it.:eek: :cry:

    Hi everyone,

    I am helping a friend claim is charges back, he's had a letter stating that his case has been transferred to a local court, when everything blew up on the 27th July I told him he would probably not hear anything until after the test case,
    He has just had a date from St Helens County court that his case is going to be heard on the 2nd October, Does this mean that the courts are disregarding the banks attempts at putting all cases on hold, what should he do now ????
    Do the court bundle and send it to the court or what ??

    Could anyone help? still waiting for a payout agreed by FOS in July. Lloyds lost the acceptance and the FOS had to resend it.Lloyds are a joke.
