If you have commenced a claim in the county court then only the court can put it in hold. Check with the court and if it has not but they have recieved a request from Lloyds for a stay ask if it can not go to the judge for 3 days to allow you to put in representations to the court. On the thread defence against a stay you will find a letter which you can use amongst my posts.
As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person

The claim is in the small claims court but the court did not say anything yet only Lloyds tsb solicitors had said in there letter that they put it on hold either they or court will contact me soon about it.<?xml:namespace prefix = o ns = "urn:schemas-microsoft-com:office:office" /><o:p></o:p>

In that case as I suggested above phone the court and ask them to not send the letter to the judge for a while to allow you to make representations and then use the information on the thread to do a letter to the court objecting to the stay.

Can anyone advise, I have sent letter to Lloyds TSB, Swallow Hse, 10 Swallow St, <st1:city>Birmingham</st1:city> , <st1>B1 2AL</st1> at the beginning of July requesting bank statements, what with the postal strikes I am sure 40 days has passed. I have not received anything, I know they have received my request as my cheque has been cashed. I have tried looking on the internet for a telephone no. so I can call them. Any ideas?

Phone customer services (0845 3000 000 I think) and explain the problem - perhaps even ask for their DPA compliance department number.

If they don't help you, write to their compliance department and give them a kick - an LBA for non-compliance should make them take notice.

I suspect the letter is aimed randomly - there is no reason why this cheque should not clear.
  • I have trying to claim my charges of £3,600 since march from Lloyds Tsb they just kept dragging things out
I wrote stating I would go through the courts, then I got a reply saying if I did that then they would ask for an postponement till the OFT court test was over,I decided to wait then suddenly 3 weeks later I was given an offer of
£750 which I have refused so even if they do ask for postponement I have started the court proceedings at least I will have had it started if I lose the only cost will be losing £30 for taking it to county court.
