Hi, I haven't taken the bank to court yet because of the test case but it is at the stage where I need to. I received a letter today offering me £750, there is no-where in the letter saying what to do to decline this. (I am owed nearly £5000) what can I do? They will just put this money in my account which will be eaten by the overdraft anyway and I obviously want to go near the full amount or even half would be adequate!! what can I do?
Write back to them declining the offer and say that you intend to issue proceedings within 14 days.As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person0 -

I just checked my account. I have one main account and one which I opened as a 'bills' account. They have put the money into my bills account yesterday. When I first tried to claim I tried to claim 2 bank accounts but my secnd letter had all the charges in (£4000+) would they really offer me just £750 for all this?

The courts will issue claims some will then stay them others will let them carry on as normal in which case the banks will probably apply for a stay.As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person0 -
Yes, as £750 is Lloyd's standard good will gesture, regardless of how much more you were claiming for. Tell them you will accept the money as part payment only and without prejudice and will take them to court for the remainder. This is important as otherwise they have every right to think that you have accepted their money as full and final settlement. If any of your charges are near the 6 year cut-off for reclaiming, it is advisable to get your claim in the system now. It might get stayed, but you won't fall foul of the Statue of Limitations Act.Reclaimed thanks to this site:

can anyone give me any advice on what to do next please? i have been trying to claim my bank charges back and have just received second letter back from lloyds stating that nothing would be done until the hearingbut do i still continue down the path of filing a court action, really confused as where to go from here. thanks in advance to anyone who could give me some advice x x0
