  • They go back 6 years from the date I first wrote to Lloyds TSB asking them to refund them. I am assuming that this will still be the case as the delay is their fault.

    In that case you should issue sooner rather than later as all the charges prior to 12 August 2001 are now statute barred and therefore subject to an argument over whether you can claim for more than 6 years cannot be claimed.
    As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person
  • I have just checked. The first charge is March 2002 so I guess I need to wait before I do anything.

    Thanks for your advice - I am finding things most confusing!!

    I am sending a letter asking if lloyds will settle with a lower amount and if not threatening court, but I'm not sure where to send it. The letter I have from them saying "no you can't have your charges back" has an address on it, Customer Service Recovery centre in Andover, should I send it there or to my local branch, where I sent the first letter? Or somewhere else?
    And where can I find my local court, I have tried searching but there are so many threads I am getting very confused :(

    I have sent off a template letter to ltb asking for my bank charges back on the 06.07.07 as off today the 15.08.07 i have received no reply , i have checked that they havnt cashed the cheque either , i sent the letter as advised by recorded delivery.

    How long should i expect to wait for a reply does the pending court case stop all pending enquiries ??? how long does a cheque remain active i thought it was three months .

    Any help and advice appreciated .

    We found that getting a reply from LLoyds did actually take longer than it should have.

    We waited over a month for a reply to the first letter. One of our letters we never actually received a reply to but as we were doing the same process for our son and he got replies we knew they had received the letters. We had put both letters in the same envelope.

    We waited what we thought was a reasonable time and proceeded with the next letter but until you get the list of charges you are a bit stuck. Don't know if its worth writing again enclosing a copy of the letter you sent and politelyl demand an urgent reply.

    It is very much a waiting game with this.
    I'm stressed enough over this - please don't add to it.:eek: :cry:

    We sent to our local branch every time. If it goes to court and you do not get paid and have to send the bailiffs in they will need to go to the local branch so you need to make sure that it is that address on the letter. Some have said you should send to certain addresses but at the end of the day our letters were forwarded by our branch to the correct address anyway.
    I'm stressed enough over this - please don't add to it.:eek: :cry:

    I wouldn't wait. The test case will go longer than March 2008 and you risk getting some of your charges time-barred if you don't get your claim in the system now.

It is disgusting they put everyone’s claims on hold have not put banks on hold to not charge people until they have solved this matter into court<o:p></o:p>
