You can sit back and wait or you can go on and put in a court claim that will get stayed until the test case is solved. Either way, you won't get much joy for the time being, but if your charges are nearly 6 years old, you should get a claim in the system to avoid getting time-barred.Reclaimed thanks to this site:

Hi all, I've been reading the threads on this site for months now, but this is the first time I've actualy started one.
I have a fast track trial in November to claim back my fees from Lloyds TSB. So far, everything has gone as expected - me asking for my money back and Lloyds ignoring me. We had both our Allocation Questionnaires on time, but after I filed my Listing Questionaire, SCAM (Lloyds solicitors) failed to respond, so the Judge responded with a threat to strike the defence out if the Listing Questionnaire wasn't filed by 15th August.
I phoned the court on 15th Aug to see if the Listing questionairre had been filed and they told me that SCAM had filed their Allocation Questionnaire. I assumed that the courts had made a typing error, so started to panic a bit thinking that Lloyds were definately going to take it all of the way.
On Saturday I received a letter from the court (I think that the letter was actually meant to go to SCAM) saying the following:
'Please find returned your allocation questionnaire which you have filed incorrectly. I have also attached a Listing Questionnaire which needs to be returned on or before the 31st August 2007.'
The documents I received were from SCAM. It seems that they filed another allocation questionnaire instead of the Listing Questionnaire and not payed any of the fees. Has this happened to anyone else?

I believe that I was missold PPI and so I am going to try to claim back the charges. I have copied the template letter (thank you) and was looking for an address to send it to, recorded delivery. The address on the statements is a PO Box, so I phoned Lloyds and asked for the suitable address, here it is:-

When I asked if I needed to put a £10.00 cheque in, the very helpful young lady went and found out for me and told me to put this in the letter:-
'I understand that there may be a charge of £10.00 incurred for this, please inform me of this as soon as possible.'

You will probably find that they will send you out a letter stating that there is a charge and that you can send the charge in. Basically think you have wasted a letter when you should have just sent a cheque for £10.I all have learnt is from others on many sites.
Seek legal help if unsure.

Reclaiming £2,000
Can you help me. I commenced claiming in March this year. After some communication I had a letter from Lloyds tsb solicitor, saying the bank were prepared to settle. They just wanted to know a few things for eg how i worked out the interst and my bank a/c number and sort code.
I immediately sent this information. The next correcpondance I received was from the court saying there was a stay on my case. This was followed by a letter from the solicitor saying the same. Surely as they had agreed to settle they should have paid up?
They had already paid out £456 on one account,:T commenced at exactly the same time, just prior to the test case.
Please help

Unfortunately many of the banks are putting off previously offered settlements - especially where there has not yet been a formal agreement to pay.
What are your personal circumstances, basically, can you make a good case for hardship enabling you to fight the stay ?

Hi everyone,
I am helping a friend claim is charges back, he's had a letter stating that his case has been transferred to a local court, when everything blew up on the 27th July I told him he would probably not hear anything until after the test case,
He has just had a date from St Helens County court that his case is going to be heard on the 2nd October, Does this mean that the courts are disregarding the banks attempts at putting all cases on hold, what should he do now ????
Do the court bundle and send it to the court or what ??
