Please can someone try and help me? I am a single mum working part time (so not on benefits but still struggling!) 3 years ago I turned my own account into a joint account with my ex partner as he was having money trouble (in hindsight not the best move I ever made!) Anyway, he went bankrupt and left me with a child on the way and a £1500 overdraft. As he went bankrupt Lloyds demanded the whole lot back from me as it was my account originally so I opened a new account and the Lloyds account was referred to collections who I have been making regular monthly payments to. As alot of charges were accrued on the account I thought it made sense to try and reclaim them to pay off the overdraft, and in July they offered me £750 from a £1100 claim, since then I have heard nothing so I wrote to them at the Andover address saying I accepted their settlement providing it was in the account within 10 working days. 10 working days are up now so do you think I should sit tight or attempt to register a case as vulnerable? Any advice would be much appreciated! The first few claims are from 2003 so no immediate danger of them expiring. Thanks in advance0

£750 is a standard amount they settle on you in full and final settlement.
We had it a few weeks ago and accepted in part payment (claiming just over £1,000) pending the results of the court case as my husband did not want to go through the court or ombudsman so if we the customer win the court case we get the rest.
If you accept in full and final settlement thats it - nothing else unless you start all over again apparently.I'm stressed enough over this - please don't add to it.:eek:0 -
I've sent my letter to LloydsTSB asking for a refund along with my total of charges (letter was sent 3 times before a response) and they've now replied with:
"LLoydsTSB has now become involved in legal proceedings with the Office OF Fair Trading in relation to bank charges which we believe will resolve the legal issues regarding the fairness and legality of your bank charges.
Usually it would be our normal approach to resolve your complaint through our internal complaints process as quickly as possible. However, until the determination of the legal issues in the above proceedings, we have asked the Financial Services Authority to suspend the normal timetable for dealing with bank charges complaints which relate to unauthorised overdraft charges and the FSA has agreed to this request subject to conditions that protect your rights.
What will happen next will depend on he courts. We do not know how long the case will take - we have promised to proceed as quickly as possible but inevitably given the importance and complaexity of the issues being consideered this may take many months to finally resolve.
Ffor now, we can assure you that we have registered the details of your complaint - and once the legal proceedings with the OFT are concluded, we will resolve your complaint as quickly as possible. If at that stage you do not agree with our response you will of course be able to refer your case to the Financial Ombudsman Service, or to the courts. Until then, please do keep all the documentation we have sent you as it will make it easier for you to support your complaint at this time.
During the legal proceedings between the banks and the OFT the FOS has decided to put all investgations concerning the fairness and legallity of unauthrised overdraft charges on hold, until a decision has been made by the courts. If you decide to refer your complaint to the FOS before then, please note that the FOS will let us know about your complaint. We will then register the complaint and write to you to acknowledge it again. Once the legal proceedings with the OFT are concluded, we will respond to you in full as soon as we can."
What is the next step now - sit and wait? I've been charged £75 again this month which isn't to helpful for a 25 year old trying to start a business (and these were for 2 return payments when the account was on the limit for just one day!).
To be honest i'm considering closing my 2 overdrawn accounts and doing a runner as it seems as though i wont ge a refund - although i know other people that have which i dont think is fair.0 -
It very much depends on whether you want to take control of your claim, or sit back and let the bank tell you what to do, again.0

Thanks for that, I did accept the £750 but am scared that they are going to withdraw it (as they still haven't paid it) and I'll be back to square one0

The money was in my husbands account a couple of days after.
My son also claimed from Lloyds and he had his letter saying how much as final settlement (more than he was claiming for) and the money was there the day before the letter arrived.
My husband was not willing to go through the court or ask for the rest at the moment. He admits if he handled his account properly he would not have paid any. But hopefully by doing an accepting as part payment we will get the rest when we win in court.I'm stressed enough over this - please don't add to it.:eek:0 -
Am I the only one that cant get a fax through to scam anyone got an alternative number instead of 01273 745351 as all this number does is ring but no answer?0

hi all i filed mcol for tsb got me letter of the courts saying its been stayed so just so i know wot im doing does that mean i just sit and wait till after the test case , they hadve defended the case n mcol , dont think i can got for finicial hardship cos me and hubby work cheers jil0
