    I thankyou for your letter dated (....) and note the contents.

    In respect of your goodwill gesture of £750 I accept only as Part payment and without Prejudice as it is still my intention to claim for the full amount.

    better then what I can come up with thanks! I am heavily pregnant and can't get anything straight in my head so need all the help I can get! I don't want this to pass cos the babes in on the way!

    thanks vickyb nice to know i'm not on my own, justhad a cold call from a fo and he says as far as he is aware its business as normal and i should get my court claim in pronto x x
  • hi all tsb,s i filled in my mcol , was served on the 1st of august, i know i was doing it after the 27th of july the test case but i just wanted it logged so they didnt forget about me lol now it says tsb have put in a defence , does any 1 know wot i should expect next cheers jill

    Mcol will say that you can no longer pursue online....you have to wait for the court now to write, but they will be in touch expect a few weeks wait but dont worry.

    hi lesley what has been your next step have you gone ahead and put in your claim yet? i still havent i need £120 coz of the size of my claim

    Edinburghlass - thanks for all your advice on here.

    Well folks - thats it for us until after the test court case. The other half for whom I was doing the claim got £750 as a good will gesture in full and final settlement and he doesn't want to claim any more. Its about £270 short of what he was going for and he says thats good enough for him. He was he admits he was totally to blame for accummulating the charges in the first place so feels the bank deserve to keep something!!!.

    Will do a letter to Lloyds saying when we win the case he will expect the rest of it plus interest but is happy to accept the part payment til then. We would still be well within the six years limit to start another claim in 2009 when the case is finally ended if they don't pay up anyway.

    Over to the 'sucessful' thread now to put a thanks etc.

  • Hi, I have read through some of the pages of this thread, but I am getting really confused. Lloyds TSB have taken over a year to send me out my statements, respond to my letters etc and now I have received a letter stating that they are putting it all on hold until after the test case.

    I sent off the two initial letters and was just about to register with the Moneyclaim website. So, should I go ahead with doing this or sit and wait it out.

    Anna that depends on how far back the charges go if it is less than six and you can wait until next year then you might want to wait I am anticipating a first instance decision around April/May next year then we have to see if there is an appeal. If any of the charges are close to six years old then you may want to put in your claim now to avoid becoming statute barred
    As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person
