    Good morning,
    I am hoping that someone may be able to share there experience with dealing with Lloyds TSB... I have over the past couple of months, tried to reclaim bank charges for my sister (total including interest £2500). We had got to the stage of threatening to take them to court (after the news of the test case, I was unsure what to do next).

    To my surprise, Loyds TSB have sent a letter (after the test case announcement), stating that they are willing to give a goodwill gesture of £750 as a final settlement and said that this is not negotiable. They have deposited this into my sisters account..

    I am unsure what my next steps should be.....

    I am not happy with the offer, I am thinking about writing a letter to say that I would accept this as part payment and will chase the remainder of the balance either in court or via regulators -Is there a template letter for this?.

    Has anyone else done this? If so, are TSB likely to remove the £750 from the account?

    Any advice would be appreciated.

    The £750 is Lloyd's standard goodwill gesture, almost everyone has received it. All you have to do is tell them that you accept the money as part payment and without prejudice only and will take them to court for the rest. Start reading the Lloyd's threat (there is a sticky with all major bank threat links in it) and Martin's emergency guide re the OFT test case on the home page.

  • Intelligent Finance paid up by return of post but Lloyds TSB just keep sending me my old statements and an excuses letter-3 lots now, inspite of me sending in the templated letters asking for refunds not statements!!!! Started this claim in April and am sending in my last letter before court.
    Any ideas on claiming excess charges back from Student Loans for their letters etc ?

    Still wins in court.

    Barclays Denied Stay Today. Won In Court <hr style="color: rgb(102, 0, 0);" size="1"> <!-- / icon and title --> <!-- message --> Bank: BARCLAYS
    Amount: 2750.50 owed in charges
    7th August 2007
    Amount won: 3944.77 (inc. interest an dcourt cost of 120)
    Method: attended court today as barclays refused to settle
    Story: 1st letter sent nov 21 06. after 2nd letter offered 1000. Refused. barclays ignored me and so took to small claim court in feb. hearing was today. v. nervous - emailed litigation to see if they'd settle. they responded T HIS MORNING and said no, they'd be attending and applying for a stay in light of OFT court case.
    Attending lawyer didn't have details of OFT case and couldn't substatiate that what it was about - judge said 'lets proceed'. There were 3 cases and he had all claimants in same room. Asked each what they thought. The lawyer then obviously paniced and asked for adjounment. She spoke again to each of us separately and appeared to 'call the office for approval'. They offered full a mount plus interest. had to sign a letter. WAHEY!!!!!

    The above information is for those people about to enter court soon, surely this gives us all hope.

    hi yea i had the £750 and i think you can still go for the money but im not sure on what to do next its all a nightmare i did get told that the money is yours to spend and a leeter should be sent to them to say you will except it but you still want the rest of your money that is owed to you...they have not removed the money as its yours you just have to keep fighting to get the rest sam x:o
  • Hi THERE PLEASE HELP, JUST RECIEVED A LETTER FROM LLOYDS OFFERING £750, BUT READING THE FORUM THIS SOUNDS LIKE A STANDARD LETTER TOO ALL. DOES ANYONE KNOW WHETHER I COULD AT LEAST NEGOITATE AS THE OFFER ISN'T ANYWHERE NEAR WHAT I WAS ASKING FOR BACK. PLUS THEY DID MENTION SOMETHING ABOUT" CANCELLING ANY CHARGES THAT THEY MAY HAVE TOLD ME ABOUT BUT NOT YET TAKEN FROM MY ACCOUNT????????????" NOT QUIET SURE WHAT THAT BIT MEANT.

    (WOULD THAT MEAN THEY SQUASH THE AMOUNT STILL IN MY ACCOUNT AT THE MOMENT.)

    My husband heard today from Lloyds - they will pay £750 'in full and final settlement'. I've told him to tell Lloyds he accepts as part payment only and will proceed with the claim for the full amount. He wants to accept this money and end the claim. He says charges were incurred by him because he is useless with money. He won't go any further and refuses to sign any more letters to proceed either via MCOL or the Ombudsman, so at the moment its stalemate with him.

    I am going to do a letter for him to sign saying he will accept the £750 as part settlement only. Also it must be put on record that he will proceed with the claim for the rest of the money at some stage. Also if the result of the test case is that Lloyds must refund the charges, he will expect the rest of the amount he originally requested. He is just not prepared to go through the court procedure or Ombudsman at the moment. So it looks like that's it for us until the court makes their decision.

    Hopefully by doing a letter worded like this should the court find in favour of us customers we will get the rest of it as we will make it very clear we are only accepting it as part payment not full and final settlement.

    This is about the best I can get him to commit to, and there's not a lot I can do about it. He is adamant. So looks like its a bit of a success - not as successful as I would like but better than nothing. The letter states there is a time limit of six months to ask the Ombudsman to investigate but I guess we could always put in a new claim for whatever he did not get after that. Or I might be able to persuade him to do the Ombudsman form before the six months is up. No way will he go the court route.
    I'm stressed enough over this - please don't add to it.:eek: :cry:

    That sounds a good letter to me and if he refuses to sign it, tell him he'll have me to answer to :eek:

    edited to add, I can see where he is coming from too and can understand that he has had enough meantime and I'd say your letter is a good compromise.
  • Please can someone help me out here as Im stuck not knowing what to do.
    I approached Lloyds with charges for the last six years amounting to just under 5,500, after two months of letters i got an offer of 750 back which they called a goodwill gesture and said they totally refuse to pay any more out to me.The bank also said they would stop all charges on the account and have since added 200 in charges.
    Do I now start court proceedings with all this new stuff going on or should I just leave it now, Im stuck not knowing what to do.
    Many thanks to anyone who responds with advice.:confused:

    £750 is the standard goodwill gesture by Lloyds and if you want to preserve the early charges of your claim you do need to start a court action or your early charges will be time barred by the time the test case is over.

    You do need to write accepting the offer in part payment only and without prejudice and that you will be continuing your claim via the courts.
