i have had a payment for the same amount and my claim is for a similar amount to yours,
i am decided not to accept, but am in the process of doing a letter stating that i will accept the payment without predjudice as a part payment until the test case or my own case has been heard whichever is sooner, i am also going to sugest that i would be willing to accept the amount with of my charges without the interest if they want to settle before such time>?
can anyone advise me on this course of action?

Hi, how do you get LTSB to pay out once you've won?
LTSB had until 12th July to pay us after our court case on 28th June.
By 1st August no money received, so a very kind man from the Judge's office had a word with SCAM for us. He said they were very nice and helpful and promised they would pay now!
Still no money. Spoke yesterday with a senior SCAM manager who denied receiving the judgement and denied speaking with the Court, being very scornful in general. (The court confirms SCAM received two Judgement Orders - one amended - and these were discussed in their phone call!)
After much unpleasantness and prevarication - including inviting us, (customers for over 30 years), to send in the bailiffs - he promised the money would be in our account by the end of the day!
No such luck - so what now? Any suggestions please ...0 -
From MCOL FAQ....
Q. The defendant has promised he will pay next week but their time to respond to the claim form expires tomorrow, what should I do?
A. Nothing will happen on a claim unless you request it to. The court will not proceed with any further action against the defendant automatically without your request.
Q. I issued a warrant two weeks ago and I have not heard anything, why not?
A. Warrants are not actioned immediately. The defendant's local court will receive your warrant. They will then write to the defendant to advise them a warrant has been issued and that they have seven days to contact the bailiff to make payment / offer of payment. If no response is received the bailiff will then visit the defendant's property. The time limit on this depends on how busy the court is, but this is usually within fourteen days. Warrants can take several weeks to action, as the bailiff may have to visit the property more than once.
Q. How will I know the progress of my warrant?
A. The court executing the warrant will update you by post. Your claim will also be updated on the website. If you require an update you can contact the local court directly and speak to their enforcement section.0 -

ive just received "another" letter from tsb... the !!!!!! are using any tactic they can to stall... apparently they are, and i quote "involved in legal proceedings with the office of fair trade," stalling...." we have asked the financial services authority to suspend the normal timetable for dealing with bank charges complaints"...stalling yet again..."once the legal proceedings with the oft are concluded we will resolve your complaint as quickly as possible," stall,stall,stall...."we do not know how long the (court) case will take-we have promised to proceed as quickly as possible but inevitably given the importance and complexity of the issues being considered this may take many months to resolve,"..... this is out rageous... im still being charged on my accounts even though i closed all direct debits/standing orders, tsb are refusing to honour my wishes in that i no longer wish to bank with them...
and to add insult to injuy they couldnt even spell my name properly...lol0 -
I have just got the offer of £750 as full and final settlement. I'm going to write back accepting as part payment. I think it is going to take a while before anyones case is resolved due to the test cases. I know that it will be a good few months yet. Oh well there goes next years holiday!0

I have been trying to reclaim £2300 from Lloyds since March this year. I have had the usual lies and stalling tactics (didn't receive letters from me etc)
I eventually gave up and wrote to FO at the end of June. I got a reply from them saying they are looking into it, but they are very busy, 2 or 3 weeks ago.
Does this mean they wil go ahead and help or will my case be suspended?
Thanks in advance!0 -
