  • Well, you all think you have it bad for overdrawing, how about this lloyds tsb took unauthorised money from my debit card for 9 months before I realised it. Then when I was in the philippines they left me with nothing .... not a penny for 12 weeks while I repaid the money I "owed" them + the 90 quid a month charges which occured because of their charges. I had to live on handouts which was basically rice for that period of time. When i got back to the uk in march 2007 i was given back 3 months payments and then told they couldnt refund the rest because of visa rules .... they then refused point blank to give me my money back .... except in july they gave me a credit for 300quid for other charges they had taken over 2 yrs which they suddenly discovered.
So this is what I did. I overdrew my account and sent them this letter.

    Dear Sir

    Account number

I am writing with regard to the above account, which you claim to have an outstanding balance. It is you in fact that owe me money. The details of which follow.

    Unauthorised withdrawals from my account.

    <o:p> </o:p>
Charges up to 1st July 2007-07
£90 per calendar Month (the same as you charge me).
    <o:p> </o:p>
    16 x £90 = £1440
+ interest on the outstanding balance @ 5% above the B.O.E base rate
    <o:p> </o:p>
I have tried to address this issue with you for a year now and you have told me that you will not repay this money to me …. Hiding behind “Visa rules”, which you claim only allow you to repay back 120 days.
    <o:p> </o:p>
Due to your refusal to address this problem I have now been forced into a situation whereby I have taken steps to recover the money from yourselves by rather devious means … hence my account is overdrawn. I have also charged you the exact same charges that you have imposed on me and I have also recovered the charges that you have applied to my account for being overdrawn because of your unauthorised debits from my account.
    <o:p> </o:p>
I did warn you that I would take steps to recover the money owed and your reaction was a blunt “NO” we are not refunding the money and I am welcome to take you to court. Therefore, I have also taken steps to stop all credits to the account until the issue is resolved. If you wish to take me to court then I am quite happy to see you there with a substantial counter claim which will far exceed the debt you claim I owe you. Also if you wish to close my account that’s fine by me too.
    <o:p> </o:p>
The next step is entirely up to you.
    <o:p> </o:p>
    Yours Sincerely
    <o:p> </o:p>
    <o:p> </o:p>
    <o:p> </o:p>
    Alfred Smith

Their response ..... nothing not a letter or a phonecall even though sent by recorded delivery

    Hello, could someone please help?

I recieved a letter dated 10th July offering £750 as a goodwill gesture, and saying that it will be creditted to my account within 10 working days. It said they would treat this as full and final settlement of my complaint but the money is still not in my account.

I rang Andover this morning who have an automated message saying that I should ring another number. 0845 6030899 who said that no claims are being dealt with until the test case is completed, but when I pointed out I have already been offered a settlement he didn't understand why I haven't recieved it. So I rang the main number and went onto the other helpline who said that he would chase it up.

Where do I go from here? Do I have to wait until the test case is done? Can they withdraw this offer?
  • I have just had a letter from my Bank (Lloyds tsb) offering me a payment of £750 as a gesture of goodwill. my claim is for £1200 + interest = £1800 ish
the letter dated the 16 of July arrived on the 29th Hmmmm
anyway it states the offer as full and final settlement, it has been debited to my account already but, i want to know if there is anyway i can accept the offer without accepting it as a full and final payment?
in short can i accept the offer as a part payment until the test case is resolved??
could somebody please advise on how to word any letters ??
PS: MSE, what an awesome site:T :T

its a standard letter from lloyds.send a letter accepting the money 'without prejudice' and say you intend to carry on with the court action for the remainder of your claim.leave the money in your account for a while just in case they decide to play silly !!!!!!s(prob wont).they did the same to me.good luck
  • hi there, i got a letter today 1/08/07 date 6/07/07 saying they would refund 750 as final settlement and a cheaque would be sent out in the next 10 working days, still not got the cheque as i am going for the date of the letter 6/07/07. i have not got a account with lloyds no more so cant be paid into there.

rand the number at andover and they said give us your bank account details and they would put the money into that account, the account i gave them is with A & L, they said the money should be in there in within five workig days, has anyone else had this situation

    cheers

Hi Durhamman, when did you get through to Andover? I have been getting an automated service then the line goes dead.
  • I have 3 accounts with Lloyds TSB, one Current, a Savings & one used to pay utility bills. For the last three months I have been charged £2 for the utilities account yet this month (for no apparent reason or warning), this charge is now £7. Does anyone know why I might be charged for having this account which is always in credit and has no overdraft facility?

You will have a Select account, which is charged at £7 per month normally.

There is a special offer of £2 for the first 3 months then £7 thereafter.

Wether you upgraded via the internet, telephone or branch, this should have been told to you. It would also have been confirmed in writing along with your postal welcome pack.

    Hope This Helps
