Several of these letters are going out from the courts to claimants so yes, its looking good if you get one as the bank either have to settle or tell all.

My son has just had his money refunded but my husband who we have been reclaiming for at the same time has not even had a reply to his last two letters (both posted to the same place at the same time as my son).

I am thinking of writing a snotty letter to the bank about this and demanding that they take some sort of action anyway as they have ignored my husbands last two letters. I know they received them as the last letter sent by him was in the same envelope as the letter sent for my son and we had a reply to that one.
I'm stressed enough over this - please don't add to it.

You can try but I wouldn't waste too much time expecting an answer now and would start court action soon.
  • Hi I am a student and have been subject to penalty fees for going over my agreed overdraft limit. Congratulations to all those who have reclaimed their charges, especially from Lloyds TSB who after winning one case seem to think they are above the law.

Now I am the first to admit that I am not in the best of financial situations and before my current situation was virtually living off my overdraft. Will the banks/courts take this into account and make it less likely for the charges to be refunded?

p.s. I am aware all cases are currently susepended just wondering in anticipation of the ruling of the test case

Who asks for this, the court or the solicitors/bank?
    Reclaimed thanks to this site:
£175 Abbey Mortgage Repayment Fee, £170.03 Capital One Bank Charges £418.07 Lloyds TSB Bank Charges, £2,671.55 Mis-sold Endowment Policy, all for OH
  • can any one help me as i'm unsure where to go next.
After 2 letters requesting the bank repay my charges totaling £3227.00, then a 3rd with a reduced offer of £2500.00, the bank has sent me a letter stating that they don't agree to adjust any charges, but on this occasion they are prepared to repay £750.00 in full and final settlement.
and that i should treat this letter as their final response.
do you think its worth me carrying on? or should i just agree.
they have also stated that they will credit my account within 10 working days, so time is short.
    thanks
    cheg xx:confused:

Lloyds? Standard procedure from Lloyds and you need to write back and say you accept in part payment and without prejudice and will be proceeding with court action for the remainder and then do just that.
