Isnt it that everything is in limbo until the results of the major court test case is decided?

    Which will be when?
I'm stressed enough over this - please don't add to it.

all new claims are suspended, however...still submit your claim, if mcol wont let you do it then do it through your local county court, it is important now for you to submit or you will be subject to the Limitation Act

  • Hi

I've had my case acknowledged, got another few days to wait for a defence. I've not had my fee refunded. What do you lot think will happen? Will I still get to court or perhaps an offer before court?

    Cheers!

Make a note of the date the defence is due in your diary if the defence has not ben recieved by then apply for judgment in default on the day after the day it was due.

I wonder if anyone can help me?
I have been claiming for £2300. from lloyds this includes intrest on the 12/07 tsb made me a goodwill offer of £750 so i then applied me mcol on this date now instead of making a claim for the whole £2300 i knocked the £750 goodwill offer off so it came to £1700 including court costs.
On friday 27/07 i recieved a letter from tsb solicitors offering to make payment of £952.71 so i phoned the solictors as i realised what they had done is taken off the £750 from the £1700. not realising that i had already done this, so i spoke to some nice man who said that they cannot amend the case what they would normally do until this test case is complete which could take upto a year, He has basically said that i could either accept the moneythat has been offerd but i have to sign the agreement which means i carnt claim for the rest of the money after or i could not agree to it and basically i have to wait then for my money.
Does anyone have any ideas i think that i should take the money and run but part of me thinks i should drag it out i dont think that they will let me have this money as a part payment as i have to sign.
    Thanks in advance Beckie
