I wrote to my bank back in January and heard nothing back from them. I'm going to send another Letter Before Action tomorrow as I've left it so long without going straight to Moneyclaim. I'm hoping they may see the light and pay up before the next 14 days are up - I won't hold my breath!0

Just to clarify, the letter I sent was the one requesting my money back. However, when I added up my charges it came to over £3000 so in view of recent developments I'm thinjing of going down the Ombudsman route - it seems to be a safer bet and the 40 days are up in a couple of weeks.

Hi I need some advice please, I wrote my 1st letter to Lloyds TSB backin March, I had one of their standard our charges are legal letters so reponded with Martins template letter threatening court action if my claim was not settled within 14 days this was May 12th I am still waiting for a response, I have telephoned a couple of times and eventually got through, the 1st time I was told they were allowed 52 days to contact me the 2nd time I was told to wait a couple more weeks, they have also sent me information on how to contact the Ombudsman as they realise I have been waiting sometime for a response. the ast time I spoke to them I was told my case was being looked at and should hear in a couple of weeks. That time is now up in fact its been 10 weeks since my last letter and I am totally frustrated with them - during the last call I was told to wait for a repsonse from them before taking further action as the Ombudsman (if I choose that route) expects that? Have any other members had this problem and can anyone advise me whats best to do - should I wait a bit longer? Contact them again? Or start proceedings??

Stick to your time limits, they have had more than enough time, just another ploy to hold things up and hope you go away! As it has been so long might be best to send them another Letter Before Action and list of charges, this time if they have not replied within 14 days go ahead and file the claim, do not stick to their timetable, stick to yours. You will get your money back eventually, I did on all my private and business accounts with Lloyds TSB.0

The Ombudsman is the way to go!:j
Phone them on 11th June, Got a ref no!
12th sent them their claim back with all copies of correspondence with bank.
Letter bank from them-14th June letter-received the form explained what will happen and wrote to bank to pay!
25th received letter from Bank- they are very busy but if I am still unhappy I must go to the Fin Ombudsman, which I already did!
Received letter from ombudsman-27th June-Inviting the bank to settle my claim!:rotfl:
11th June Letter to say that bank will settle my claim in full and I must just sent the acknowledge form back.
18th June- Just to let me know they despatch my acknowledgement to the Bank and they must pay but it can take up to 6weeks.:T
Just need a number to ring the bank because I can not see that it will take so long to transfer money from one account to another

I have had exactly the same response from TSB, though I sent first letter in May(lost in post) second letter on the 19th June with cheque(signed for) cheque was cashed on the 20th July.
Hang on for 40 days. I have tried to call the numbers, all mail boxes full etc. I'm just going to wait 40 days and then refer it straight to the FOS.

Add another 2 to the growing list a non response tactics by Lloyds TSB. Sent one for me and the wife, both went recorded on the 23 June, looked on the website today only to find out they both haven't been signed for, or arrived. I'll send mine again and add the price of 2 more recorded deliveries to the list. Very sneaky Lloyds:T :mad:

The wording in the above case refers to amending the POC but you could reword it to say you want to change the amount of your claim. You need to do this at your local court so I would ask them at the court if you need to do this in view of the fact that your hearing is two days later or if they think you could just take your amended claim with you.

I think you can download the appropriate form on the court site so you could maybe do that, fill it it and take it with you on Wednesday.0
