    .....and it doesnt say im not getting the charges back, all it says is "im sorry that you feel unhappy about with your account charges"

    im about to send a second letter to the bank, one of Martins templates, and was just wondering if it is worth asking for below £5k , the claim is for over £7k and was thinking in the long run would it be easier to claim back under £5k and save the hassle court by being able to go to the small claims court if the worst comes to the worst?

    You can do anything, but you will have to amend your claim at a cost of £35

    Hi

    Just to let you all knw finally i have received settlement with Lloyds and have finally got the money in my account.
    Previously posted back in May on acc 1 received 2200.00 and today received 2700.00 on acc 2.

    Has taken since Nov 06 both started at the same time, but acc 2 not so easy, but at last its over.

    Keep going everyone.

    I wrote to Lloyds some weeks back requesting refund of all the default charges associated with my current account. Have finally had a response but it seems to be non-sensical.

    Essentially it says, ''I am sorry you are unhappy with your charges'' etc etc, but then goes on to quote some Office of Fair Trading guidelines about credit card default charges, saying that these guidelines do not apply to my 'service charges' and that I have not broken my agreement with Lloyds and that therefore my charges can't be cancelled/refunded.

    Have I misunderstood, or is this completely irrelevant drivel? I thought the reason we are able to claim back charges is because they are punitive ie out of all proportion to the costs incurred by the bank, not because some guidelines relating to credit card charges can/can't be extrapolated to current accounts?

    Has anyone else had a similar letter ie is it a standard response? (it's from John Compton of the Customer Service Recovery Centre in Andover - I didn't even write to them in the first place?!)

    PS Apologies if this has been dealt with elsewhere but some of the threads are very long (200 pages plus) and I gave up after wading through several.

    We did the usual first letter to Lloyds TSB and got the standard response so sent a second saying we would be taking them to court unless they made an offer to settle in the next 14 days. They replied at the end of the 14 days saying they would give us £750 in full and final settlement of all claims and would put it in our account within the next 10 days. We were claiming just over £2000 but were prepared to settle for a bit less, so phoned to see if we could negotiate a bit rather than having to go to court.

    We phoned well within the 10 days they gave us, but when we checked our account, they had already paid the £750 in. We have not signed anything at all to say we agree to it being full and final settlement, and before we noticed that it had been put in our account, we had already written to them saying we werent accepting £750.

    Just wondered if this had happened to anyone else, and whether you could still go on and claim the rest back?

    This is their standard reply. Ignore it and move on to the next step :)

    This is their normal fob off waffle! Unless a letter contains sums of money and the offer to refund it to you ignore every word they say! lol. Stick to your guns and to your time frame not theirs and you'll be rubbing their noses in it in no time!;)

    Thanks very much - I already have the claim saved online in 'Moneyclaim' and just need to pay my credit card fee and get it going now..... 8-)

    Write a letter back to them stating you will accept this offer as Part Payment only Without Prejudice and that you intend to carry on with the courts to reclaim the rest of the monies owed to you but deducting the 750 from the total claimed.
    This is a standard trick of Lloyds in a desperate attempt to make you give up and go away. Don't give them what they want keep going and i will bet you'll have the rest of that money in no time at all.

    Send the second letter threatening court action but then you would be advised to put your claim through the Financial Omubdsman due to the size of your claim. Have a read of Martin's article regarding using the FO.
