    HI there, i sent a letter to LLoyds TSB back in May asking for mine and my partners charges back (2 seperate accounts, 2 seperate letters) including the interest. I receieved a replies back regarding both accounts which was the usual rubbish that they are lawful, but if i was unhappy with this letter they would keep my records on file til august.

    I then sent the letter template saying they had 14 days to reply with my money or i was goign to court, And i thought i was fair as i didn't increase the interest! but i have not heard anything, not even a letter sayng they received my letters.

    IS THIS NORMAL??? Do i just continue to take them to court or shall i wait for a response??

    I need help as i'm unsure what to do!

    hi all,

    hope u can help me:

    After receiving my statements i have a claim of £685 for unfair bank charges - using this website to calculate interest on all the lines individually this upped my claim to £900.60.

    I sent this info onto lloyds (12.05.07)who promptly responded with the standard letter of "these are fair charges etc blah blah...you can speak to the financial ombudsman blah blah if we do not hear from u by 02.08.07 we will consider this matter closed.

    I then resent a letter (12.06.07) sayin i want them repaid an if no response i will proceed with court action after 14 days....i did not get a response..so started filling out my form on MCOL...when i got to the fisrt bit about my charges and interest the figure differs to that i calculated on this site...is that ok to submit the claim for slightly less (bout £70) or will this throw my claim out the window? Also i did not follow this up as it would cost £80 to process, i could not do it at the time when the 14 day deadline was up, so i waited to see if i'd get another letter from Lloyds...i didn't so i re-sent another letter on 04.07.07 saying i would start court proceedings if they did not respond within 7 days...this period has also expired and i don't have the funds to proceed until friday 27th - does this throw out my claim altogether or will i be ok proceeding and does it matter if my amount differs on the court claim to that i sent in the letters? Also none of my letters were sent recorded / special delivery..regret that now!

    Any help would be much appreciated as i think i may have blown this!icon11.gif

    Sounds about right for Lloyds TSB! They did exactly the same thing to me. If you sent it recorded delivery check online that they received it, and if they have and they have not responded in the 14 days you allowed them simply move on to the next step.
    When they didn't respond to my second letter i automatically assumed they were trying the old 'ignore the problem and it will go away' delaying technique and i for one was not going to admit defeat that easily.
    If they have had the 14 days and they have received the letter go on to the net step and make good on your threat!
    Just to give you a heads up when i spoke to Lloyds solicitors they informed me that they have been instructed to defend every claim at this point so do expect a defense to be put in. On the up side though, 3 weeks after they said they were defending mine they payed up in full without and fight.
    So stick to your guns and Good Luck.;)

    yes it is normal for lloyds esp.continue with the court action and dont let them intimidate you.keep to your time frame not theirs.dont worry and good luck

    Relax - you can file a court claim anytime, and it does not matter that your amount differs from the one you mentioned in letters before. With a court claim you can start afresh, so to speak, you can even add additional charges during the process (for a small fee). As for not sending letters recorded - they obviously got your first letter, and are known for ignoring letters anyway, so I wouldn't worry.

    hiya dont worry about not having the funds for your court case, i, like youselves wrote lloyds weeks ago and still have no reply so ive filled out my claim online but cant actually pay for it til end of tis week and then ill proceed.goodluck jamesdono.
  • Hi everyone, I've just joined the forums today, but have been using MSE.com to reclaim my girlfriends bank charges from Lloyds TSB.

    We have just got to the MoneyClaim online stage, and have noticed today that Lloyds TSB have acknowledged our claim.

    Has anyone recently had experience of dealing with them, as I was wondering if they are still doing this as a token gesture and then not defending - could anyone in the know please give me some pointers??

    In a recent conversation with Lloyds TSB solicitors the ever so helpful woman on the end of the phone informed me that they have been asked by Lloyds to put in a defense for every case. Saying that they are still settling out of court with large numbers of people (me being one of them). I really wouldn't worry at this stage about about if it will go as far as court as you could be right about your case, it could be they are just defending for show and they don't ever intend to go as far as court!

    to claim the interest ( are you claiming on the 8% per annum?) if you are then you need to do a re-schedule of charges this means you have to take the date on which you where deprived of the amount and calculate how many days up to date of issue....then I suggest you read this post by rex_mundi
