  • Most of you seem to have gone thro' the Court System. Has anyone tried the Ombudsman route?
    I am trying to reclaim £3929 (going back over 6 years) for my son. When we wrote to Lloyds TSB in April sending a 4 page spreadsheet detailing the charges. In May we had our claim rejected (as I expected).
    I have just lodged the complaint with the Ombudsman but I would welcome advice whether it is better to go straight to Court.
    Does anyone know the success rate at the Ombudsman? What sort of timescale are we talking of?

    I am going via the FOS (claiming 4500.00).
    After submitting, the form should get a replay within a week telling its now passing to casework administration area.
    You get a letter from them, about a week, given details and timescale. This is about 6 weeks if it has not been settled.
    As for the £750.00, I emailed FOS (including my FOS ref number) informing them that I had received this and had written to Lloyds them that this did not meet my claim and that I had passed it to the FOS.
    On the email to FOS, I requested that continue with my claim.

    Its always best to notify the FO if you have received the standard Lloyds goodwill gesture also write to Lloyds and tell them that you are only accepting this in part payment and without prejudice and are continuing with your claim either via court or the FO.

    You'll find wording in this thread for such a letter...

    Received letter last week from Lloyds TSB solicitors in Brighton offering me full settlement plus interest (@ £1,800). I had a court date in August set, wrote back accepting their offer, money paid into my account in TWO days!! Feels great to have won! My advice to others is - keep going, you will all get there in the end! I started my process way back in January! :beer:

    Hi All,

    I've received a letter this morning from LloydsTSB solicitors (Brighton). They're defending the proceedings, on the grounds that there has been no breach of contract between myself and the Bank.

    The intersting bit is this:

    They are requesting I contact My local Branch manager, as the situation gives rise to a dispute and it is not the banks wish to contine. They're requesting I contact my local lloydsTSB Branch Manager on their 0845 number to review my account, I have to do this within 14 days, and a review of my account may be useful to consider wether my current banking arrangements are the most appropriate for me?

    What should I do folks? do I ring, as I have a large overdraft with them, and I'm thinking they're gonna take this off me, and ask me to pay it back immediately, or close my account.

    Any ideas anyone - please help - thanks

    I have had to phone MCOL up this morning as I have had no transfer of proceedings notice from them. I had a letter last month stating that LLoyds would be defending the claim. MCOL said that they would take it up with a manager as I should have had a transfer of proceedings by now. I hvae to ring back next week when they said everything should be sorted and they can tell me what stage my claim is at. Do you think my claim has gotten lost somewhere?

    My partner set his settlement docs off to LTSB solicitors and they received them on 11th July. He is hoping that they will have put the money in his account next week.
  • I am in the process of claiming back unfair bank charges from Lloyds tsb and Im unsure what to do next. So far I have sent them the first letter using the template from this site, asking them to send me my last 6 years charges, I sent them the statuary £10 cheque, they sent these to me within the 40 days given, I then sent them the next letter again using the template asking for my charges and interest which amounted to £3304 to be paid back to me, they were given 2 weeks to reply, I didn't hear anything so after 4 weeks I sent the third letter threatening to take them to court. Within 2 weeks I received a letter which basically says they are sorry Iam unhappy about my account charges. They then give me alot of jargon about how they feel its fair that they charge if you go overdrawn etc, they then say if I have asked for copy statements and paid the fee they will send them within the 40 day limit and if I have not yet sent it then I should do, which as I have said I did a few months ago, they finish by saying I hope this fully answers the points you raised with us. Please let me know if there is anything else I can do to help. If you are happy with the way I have dealt with your complaint there is no need for you to reply to my letter. If I have not heard from you by the 10 September 2007 I will close my file.
    There is no mention of me asking for them to pay back my bank charges. Any advise on what to do next would be greatly appreciated.

  • I started my claim process in December 2006, after the 2 standard denial letters from Lloyds, I put in a MoneyClaim application for over £3000 (charges plus interest) of fees from between Dec 2000 and Nov 2006, back in Feb 2006. This was refered to the county court, who sat on it for 2 months, before the judge decided such claims were wasting court time, so he has requested that it is transferred back to the small claims court.

    To quote the 'General Form of Judgement or Order' I recieved:-
    It is ordered that

    The claiment shall by the 21st Jully 2007 file and serve on the defendant a schedule setting out each charge of which the claiment claims repayment, together with an explanation of the basis on which the claiment claims that each charge is unlawful or any basis on which the claiment claims repayment.

    I'm a bit lost with this as it seems to have gone full circle, I have basically written a letter duplicating the N1 form wording (available from a link on this site), included my original list of each charge and their total, this was each and every 'excess overdraft fee' and 'unpaid direct debit' charge, plus interest calculated at 8% from the date of each fee.

    My problem is, reading from the 2 failed cases, that were largly due to lack of preparation, what should be included with my documentation that I serve (by the end of today), I have copies of the Terms and Conditions for 1996 and 2000, and a copy of the OFT's letter on 'Action on credit charges default charges', should I include these, do I need to do some sort of covering letter saying that I have included them, or are they not needed at this stage, or do I need any other information ? After being crippled by the bank since 2005, I really could do with getting this cash back

    hi both me and my paetner have been told to do this i rang and made appointment and 3 days later money was in my account (after signing the acceptance of course) and my partner has not rang yet but money has been paid into his account as well. I would sign and retun a copy of the letter and see what happens SCAM told us would take 2 to 3 weeks to pay out but mine went in yesterday and my partners this morning about 6 days happy days and good luck:beer:

    Hi all, I made a post a few weeks ago staing that I have had no questionaire from the County Court in Swansea as of yet. However, Yesterday i recieved a letter from the courts stating the my case would be heard next WEDNESDAY!!!!.
    The day before i recieved a letter from SCAm stating that they wanted a detailed breakdown of all of the claim that i am making. Which i sent off to them by fax on the same day. The claim is £1200 in charges (inc the intereset that they were charging), as well as the 8% interest and MCOL fee's totalling £1900ish.

    Firstly, Have i made an error in charging them for the interest that they were charging me on the charges (could be confusing), as well as the extra 8% that i have calculated on the total.

    Secondly, as i have only 5 days before my hearing, what do i need to do and take with me, as i can't see this one being settled in the short time remaining.

    Very, very nervous Rich now.
