  • My Lloyds claim has been acknowledged today (19.07.07).

    Can someone tell me what the process is from here in? Do they have 28 days to compile their defence? Could I expect to get a court date? At what point might I expect a settlement?

    1st letters received on 16.02.07 for HSBC, Goldfish, Tesco, RBoS & Lloyds TSB

    They generally file their defence on the last day. Expect Northampton court to transfer it to your local courts and then a date will be set. Next Wednesday in my case!!!! I have had no settlement offer as yet, not even the standard £750 which most seemed to have got. I must have been a bad !!! in a previous life!!!

    they have until the 02/08/2007 to file a defence depending on the date you issued your claim. You could receive a settlement before this happens, however, they may file a defence in which case you will then have to wait for a court response.

    i'm wondering if you could help me. I've had a letter from Lloyds TSB solicitors offering the full amount i've claimed as a gesture of goodwill. they say it is not an admission of liability but are willing to pay me the full amount as pleaded in full and final settlement, subject to terms and conditions!!

    they say not to show this letter to anyone else and to sign a form if i accept and send it back to them within 10 days.

    what should i do now??
    please can someone advise me,

    Sign it and sent it back and you should have the money in 2-3 weeks! :beer:
  • i have done that - i think i may have messed up though because i've stopped the court proceedings! i did it online and said that the back has offered to pay me. do you think i should contact the court and tell them i did that in error?
  • I have had today a letter from Northampton court saying that my claim has beentransferred to a court near to where i live. In it it says "IT IS ORDERED THAT- The filing of an allocation questionnaire be dispensed with in this case unless the District Judge at the court of transfer orders otherwise" There is no questionnaire with this letter only a form from the bank contesting my claim with 4 paragraphs for its defence quoting Rules 16.4 1A of civil procedures etc. What do i do next? Please help.

    The judge that it has been passed onto will now make up their mind if the want you to have an allocation questionnaire so all you have to do is wait. If the judge chooses to give you one then you will be sent one in time.
    Looking on the bright side, if you are up to this point in the process, you are nearly at the end of the line.

    I've used the 1st standard letter from this website and today have recieved a letter from the bank saying that the OFT and that as I've gone overdrawn I've broken the agreement and that I should send £10 to get copies of my statements! How should I now proceed?

    Hi All

    I rang Scam today to ask how long it would be till i got my money, the girl on the phone was very nice and told me there is a back-log so it would be between 2-3 weeks, not what i wonted to hear but what can i do.

    Sorry to ask again but does anyone know if there is a temp letter telling the court you are taking a full and final offer, would be great if some-one could help.
