Have just spoken to a lady in Oxford crown court who told me that no cases with Lloyds/ Barclays/ Halifax or anyone has gone the distance, they either settle the day before or a while before it gets to court.

My bank have till tomorrow to submit their skeletal legal arguments after which I can request their defence be struck out, fingers crossed!

    You've done exactly right.

Have you re-iterated the fact that if they do not refund you the money which is rightfully yours, that you will be taking the matter further? Give them another 7 or 14 days or something and then go via moneyclaimonline.

^^ THANK YOU VERY MUCH FOR THE ADVICE

NO i didn't give them a time limit because as i had already started a claim with FO and then i found money in my accound just by chance. I thought i should send them the letter in case they close my case thinking i accepted the £750 and that was it.

Should i send them another letter or just leave it for the FO to deal with. Should i also let FO know that the bank placed money in my bank

  • WON £1158

Sent the last letter from Lloyds Solicitor teling me they want to settle out of court... signed and sent the letter back to them. Two days later to that there was sitting a nice £1158 in my account :D

    Now turn for Barclaycard.
  • Hi, I recieved the standard letter today from Lloyds with the £750 settlement figure. Am i right in thinking they will just pay this without me agreeing to it? If so should i do the same and write to them to say i agree to the £750 as part payment and then take it to FO? Should I leave the money where it is? Could they claim this back from me at any point?? Its all v confusing!
  • Most of you seem to have gone thro' the Court System. Has anyone tried the Ombudsman route?
I am trying to reclaim £3929 (going back over 6 years) for my son. When we wrote to Lloyds TSB in April sending a 4 page spreadsheet detailing the charges. In May we had our claim rejected (as I expected).
I have just lodged the complaint with the Ombudsman but I would welcome advice whether it is better to go straight to Court.
Does anyone know the success rate at the Ombudsman? What sort of timescale are we talking of?
