    Incidentally if this guy says the bank will settle on your full claim today tell them you won't be canceling the court hearing until such times as the money is in your bank. Make sure any offer includes interest and your court costs.

    How do I notify the court?
    Do I ring them or put it in writing that I have received this amount?

    Can they stop me going for the whole amount now?

    I don't want to mess this up now it has got this far.

    We are the same as u started claiming in May 07, gone thru the scary court process, letters from LLoyds solicitors,as they filed their defence claiming lawful charges, blah, blah, blah. Just got hearing date set for September and coincidentally an offer has arrived for the full amount incl court costs. We have accepted the offer however will not be cancelling proceedings until the cash is in our account.

    Lloyds TSB have just charged me a total of £90 (plus interest) for exceeding my agreed overdraft limit by £40.22p. I've phoned and asked for their reasons but they just say that this is their policy and that I signed up to these terms and conditions so I can go and boil my head (in effect).

    They are going to send me a letter with a breakdown of these, so-called 'charges'. They sent me one pro-forma letter. I can easily see this costing them 90 quid. Not.

    I've fired off my first letter to them (thanks to this site) and I intend to reclaim every last penny of every charge imposed on my account in the last 6 years (plus interest).

    I've signed up to the forum and this is my first post. So something good has come of it!
  • This is my first posting since we began the claim process against Lloyds TSB in April. It appears that what is happening to us is a 'text book' response by the bank with stalling letters and filed defences. We are currently awaiting a date at county court and are claiming about £4200 in charges plus interest.

    This morning (17 July) we received a letter which was dated 6 July, postmarked 13 Jul telling us that £750 would be paid into our bank account in final settlement of our complaint (ie on 16 July). And lo! £750 has appeared in our account. I note from some of the forums that this appears to be another tactic they are using but has anybody been in the situation whereby they never even had a chance to react within the bank's 10 day deadline? We are furious.

    I have drafted a fax (no point phoning!) to refuse their kind offer and to inform them that we are continuing our claim. Has anybody else had experience of this? I do not want to be seen to be accepting this money if it will jeopardise our claim in the future.

    Grateful for any advice

    Practically everyone claiming from Lloyds has this standard "goodwill gesture"!
