    I have no idea to be honest. I doubt the court would throw out the case on that basis as HSBC would need to enter a defence that you had overclaimed.

    Do you have a copy of the defence from HSBC, the court should have sent this to you.

    I've got their defence somewhere at home and if I remember correctly not once they mentioned that I was claiming the fees as well. They have defended the WHOLE claim and I think it was the usual rubbish that these charges are all lawful and are in their T&C's for everyone to see who opens a current account with Lloyds TSB.
    I guess I'll just wait. Maybe they forgot about it and I'll win by default?...

    Hi Katuska, I believe they are holding out cos of your account fees claim. It is something we agree to and get told it will cost and how much. It's not a penalty charge. I don't know how that might effect your case this friday. If you haven't already, go to CAG website you'll find loads more info there. Hope this helps.

  • So do i just signe the letter and agree to their t&c which basicly means they are right and we are wrong to get my money???

    Has anybody had their money yet after signing the full settlement offer?

    Hi Edinburghlass

    I Have two claims going to court on the 11th Sept and I need help, Lloyds have now paid into my account £750.00 a goodwill gesture stated on my statement, what do I do about that and do I notify the court? I am claim £1400.oo interest and the second claim is for account charges £450.00 as they changed my account to a chargeable one without my knowledge the proceeded to charge me £7.00 per month.

    The court says I have to submit to the bank a list of all charges, I sent them a copy when I logged the court papers do I have to send them the same thing again?

    I really need help now.

    Oh My God!!!

    I just called Lloyds TSB's lawyers and enquired about my case and what they were planning to do as the hearing was in 3 days time.
    The man on the phone said that on his file it says that the case was settled.
    WHAT????????????:huh:

    We never settled anything!! I received a partial payment of £715 and once it was in my account I called them and said that it was unacceptable as my total claim was around £2400. So I was told, ok no probs, I should continue pursuing my claim, even if it means me taking them to court.
    So when I entered the case in court I added into EVERY official paper that Lloyds made a partial payment of £715.

    What is going on??????????
    They received all kind of paperwork from me and the court so they MUST have known the case was still ongoing.
    Did I make a mistake contacting them? Should I have just kept quiet and won by default on Friday as it seems they wouldn't even have turned up?

    Now the man said they'll look into it and get back to me.

    Grrrrrrr.

    If the court have asked for another list of your charges etc you need to send it and then add at the bottom that a goodwill gesture has been paid and take it off the total.

    Well I would reckon your mistake was in not putting in writing to the bank that you were accepting the goodwill gesture in part payment only and were proceeding to court for the remainder, however as you say they will have received all the paperwork from the court etc and I would say it just hasn't been tied up with your claim.

    Hopefully it should be now you have spoken to the solicitors but I would give them until 4.30 today and phone back again if he hasn't got in touch with you before then.
