    ive had this 750 pound tactic by lloyds should we just carry on through mcol or can they in some way defend themselves using this payout even though we havent accepted?

    I can't find any really quickly so I've written this brief couple of lines, and to be quite honest its all you need to say!


    Dear...

    I accept the amount of _____ as part payment and without prejudice to my full claim that I shall still be pursuing through the small claims track in the county court.

    Might I also remind you that when I win in court you will be ordered to repay my claim in full, including interest @ 8%, my court fees totalling _____, and in recompense for my time and effort for bringing this case against you, a Self Litigation Fee of an estimated £230.

    Hi I just wanted to know if anyone was having the same problems as me? mcol is unavailable is there a reason for this? Is anybody expienceing the same problem?

    I started proceedings through MCOL with Lloyds, I received a letter from Lloyds (not SC&M) offering me £519 as a good will gesture, this was a couple of days BEFORE the letter from SC&M came through saying they would be defending. I am happy to take this and end the court proceedings, how do I go about doing this?

    There were no instructions in the letter from Lloyds, they told me they were giving it to me and the money was in my account the next day, no option to decline their offer, although I am happy to take it and end things.

    Do I have to write to SC&M to tell them I am accepting the £519 that Lloyds put in as full payment? Do I have to write to the court to say to drop it? Or both? Will I need to inform Lloyds directly of anything?

    Little help please :o

    You need to email/fax or phone MCOL that you have settled your case and as Lloyds haven't asked you to return or sign anything, then thats it. Its up to Lloyds to notify their solicitors.

    Standard procedure from Lloyds and it depends on the amount you are claiming as to how much they offer at this stage.

    You need to write back and tell them you are accepting this as part payment only and without prejudice and will be continuing with a court action for the remainder.

    It makes no difference to their defence or indeed rather the opposite as they have admitted some liability by offering you a goodwill gesture.

    Dear All,

    My case with Lloyds got to the point where the Court hearing will be this Friday (20 July 2007). This whole thing has been going on for over 8 months now and they wouldn't budge. Is it a normal thing for them to hold out for so long? My partner claimed over £3000 from HSBC and the whole process finished with HSBC paying up full in 6 weeks. And here I am claiming around £1500 and nothing happened for 8 months.

    There's one thing that made me think:

    I claimed both charges AND account fees (the 7 quid that they keep on charging me for account maintanence) so is it possible that they're holding out because of that? The account fees are around £300 of the total so surely they don't wanna risk going to court and being questioned over £300? Wouldn't they have settled by now?

    Really confused and thoroughly annoyed as it is taking sooo long.

    Any advice, please?

  • Hi everyone just a quick update on my claim against Lloyds. We started our claim in March, wrote the usuall standard letters and ask for our money back. They just denied it all and was saying this is our right. We then took them to court in June they filled a defence and at beginning of July we had a letter saying that our claim is being moved to our local Court and awaiting a court date.

    My husband just called me at work and told me they sent a letter that they are willing to pay us in full £3000 we are claiming plus interest and court fee of £220 eventhough we only paid £130 so far for the court. LOL So we are making +.

    He sort of read the letter out to me will need to read it tonight when get home. But the only think that sounds quite weird is it states that you should not show this letter to anyone else. i.e court solicitors. Has anybody else had such a letter? We got to sign that we accept the offer and send it back by Monday the 23rd not leaving us alot of time as we only got letter today.

    Can anybody help or advise??!!!
