Claiming £300. inlc interest
I dont now if you can give me any advice, but i have finaly had a letter from Abbey saying that they dont agree with me and that they feel the charges are correct I can wite back within 8 weeks or take it to the financial Ombudsman I'm not sure whether to apply for court proceedings, first? I have heard that Abbey have been more difficult to deal with? Please can anyone help?Started the process in Feb 2007 with Abbey National
Claimed: 4576.73 (with interest & costs)
Repaid: 4000.00
Offer letter received after I sent them a letter saying was willing to settle out of court. First offered £3430.00 but phoned up and said they lowest I would take is £4000.00. they accepted this without negotiation. Really happy cos I was getting fed up with the wait and the stance taking from both sides.
they are actually OK to talk to, and seem to want tis whole claim thing over and done with. i suggest that if you want to settle before court, try make a settlement soon after you receive their defence.0 -
Really not sure if im doing this right? Anyway, im in need of some advice! Im in the process of reclaiming my bank charges from Lloyds TSB. Ive got the charges details, sent asking for money back, told no and are lawfull, as i expected, sent letter saying going to court unless they give me my money back. Its now been 52 days and heard nothing. Rang and was told theres a back log and to be patient for another couple of weeks? Should i wait to see their reply or start court papaerwork???

One more question, I have a credit card account with Clydesdale I am reclaiming more than I owe, so I have asked them to freeze the account until this is resolved, am I being cheeky or am I in my rights to do so. I feel I've paid them enough already!0 -

My case with Lloyds got to the point where the Court hearing will be this Friday (20 July 2007). This whole thing has been going on for over 8 months now and they wouldn't budge. Is it a normal thing for them to hold out for so long? My partner claimed over £3000 from HSBC and the whole process finished with HSBC paying up full in 6 weeks. And here I am claiming around £1500 and nothing happened for 8 months.
There's one thing that made me think:
I claimed both charges AND account fees (the 7 quid that they keep on charging me for account maintanence) so is it possible that they're holding out because of that? The account fees are around £300 of the total so surely they don't wanna risk going to court and being questioned over £300? Wouldn't they have settled by now?
Really confused and thoroughly annoyed as it is taking sooo long.
Any advice, please?

Went through the process exactly as recommended on this website. Many many thanks to you guys - my kids now have a holiday to look forward to this year as booked today!!!!!
Lloyds played hardball - denying it all at first and forcing me to the small claims court. BUT £1003.80 suddenly turned up in my bank account yesterday just two weeks before court date, and with NO warning whatsoever!!
SO, why have they settled at a lower amount without my permission? Should I still go to court for the missing £107.92????0 -

Hi, when you say mortgage charges what kind of charges were these ? were they late payment fees or returned direct debit fees ? im asking because im trying to claim back some of these and just wondered if anyone had succeded.0 -

Well, it's definitely too late to change anything now, besides it wouldn't get to the court on time for Friday. I still think that as they charged my account with these unlawful charges in excess of £1200 they would not want to appear before court and answer any questions about why they levied these charges on my account.
