    I thought that having received my charges into my account that it was all over. How wrong I am. About a week before Barclays wrote offering me a full pay out, I had a letter from them about my overdraft. I responded immediately in writing, and after they received this a man phoned me on my work number to come to an agreement on how to reduce the amount each month. I was on the phone approximately 25 minutes to him, during which we reached agreement, and he said he was then in a position to pay my direct debits. I made him aware that I was in the process of claiming back £4,500 which would totally clear the balance, and then some.
    On Friday I got home to find a letter from Barclays mortgage people saying I hadn't paid the 1st July payment, and they have charged me nearly £200 interest - what I am terribly angry about is that I phoned Barclays straight away, and they claim that there is no telephone call recorded to me at any time in the last 6 weeks!! I received a letter from them confirming the arrangement, but they say that no converation ever took place. They are calling me a liar! In effect the chap who phoned me forgot to pay the mortgage direct debit after we had made our arrangement. How can they justify charging £200 interest on a mortgage payment of £670? I have the funds to pay the mortgate - I have never defaulted in almost 20 years, and only have 9 months left to pay. I am so angry and feel that I being victimised because I have won my claim. I know I had the telephone call and I know what was said in the call. They say that all calls are automatically logged, and that I have no evidence that the call ever took place! The letter following the call states "please find details below of the arrangement you have made with us to reduce the balance .... etc". How can this arrangement have taken place if I had not had a telephone conversation? I am so stressed and upset. Please, what should I do. They have messed up big style. Can I ask them to explain where they get such an outrageous sum from for a mortgage payment that is 14 days late, and is down to their incompetence? :confused: :mad:

    Barclays Bank are fast becoming a "back street" organisation.

    BUT, you have already provided the answer to this above

    "The letter following the call states "please find details below of the arrangement you have made with us to reduce the balance "

    You ask them HOW you made that arrangement ?????

    WAS IT THE PHONE CALL BY CHANCE ?

    Confirm back to them in writing that you did make the phone call and despite their call logging system, you are intimidated that they are calling you a liar.

    £200 CHARGE ???? THIS IS ANOTHER PENALTY CHARGE. ASK THEM FOR A FULL BREAKDOWN OF THIS CHARGE.

    You know the day you phoned and you also have a logging system, it's called your telephone company. Ask them for a statement of that day so you can provide proof that a phone call was made.
    Suggest you issue a complaint about this to the OFT.

    As the ethics of these banks decline daily, if anyone has a verbal conversation you must log the time and date and the name of the person you spoke to, plus the department he/she is in.

    Thanks again Cyberman. I have just phoned their collections department again, and they now say that there was a called logged to my work number on the 27th June (I can now confirm myself that this was the date that the arrangement phone call took place), but that the person who called me said that I said "No" and hung up! Why would I? This is totally untrue and I even told them today virtually the whole content of the call right down to the fact that we talked about football whilst he was waiting for the computer to up-date. And I did say "how could you confirm in writing an arrangement you say never took place!". They have given me an official complaint number and assured me it will be looked into. I think he must have agreed with me, but I am really upset at their attitude. I feel like a criminal! And yes, I am going to ask them to justify the breakdown of those penalty charges. I am seriously considering suing them for stress/defamation of character! Once this arrangement had been put in place on the 27th June, there was sufficient in the account to cover the mortgage coming out on the 30th!

    Just to clarify a few points here. If you have a complaint about the bank its the Financial Ombudsman that you need to file a complaint to, not the OFT.

    If you have putting your complaint through the FO you will be allocated someone who will deal with your case, they are not dealt with in batches.

    It is/was the ICO who deal with complaints regarding receiving statement/information from the banks and they are/were sending the complaints to the banks in batches on a monthly basis.

    The "fighting fund" is a joint fund set up with Martin and CAG for a specific case and is not something that is available purely to fight your case in court.

    Theozziend, put in a complaint to the FO regarding your above post.

    Thanks EG - I think I just might. It's so unfair to make someone feel as if they are going loopy. I am so frustrated because I KNOW that phone call came in to me at work, and I KNOW what was agreed in the call. The guy was tapping away on the keyboard as we were speaking, so where has that information gone? They are in control there, and I am being penalised, yet again, for their incompetence. I spoke to the same guy on Friday evening and again this morning, and on Friday he had me in tears he was so rude and made me feel so cheap. Several times he said "I am going to end this call now as it is going no-where. You have no evidence". How dare he. :mad:

    Hello All once again,
    I have logged my credit card charges to money claims online. However instead of entering the credit card address which is:
    halifax credit card services
    pitreavie business park
    dunfermiline
    ky99 4bs,

    I have entered the main branch naddress which is:
    Halifax plc
    customer relations
    po box 548
    leeds
    ls1 1wu.

    DOes anyone know if I have to change it as its halifax credit card services, I am after . Someone please help as I am very very very worried?

  • Since asking the bank to pay my charges back to me they have been playing games with me, my card ran out at the end of June, I have had 2 new cards, both have been kept by the machine. I have applied for my 3rd new card, the postal strikes are holding this one up!!!. Is this a common practice when asking for charges back. They have made me more determined to reclaim them. I am now about to threaten court action.

    Hi everybody. Apologies upfront for the length of this.
    I have recently helped my son, with your help of course, get back £700 from A&L. I am now trying to plough my way through my brothers claim but have come up against a weird letter from his bank HSBC.
    We sent the original letters and got the statements for his business account totalling £3366.We sent the 2 letters requesting a refund and then another reply. The letter says" whilst I am willing to review your claim for reimbursement of certain overdarft fees incurred where a transaction exceeded a pre agreed facility, I am not prepared to consider any claims that include any other services you may have previously requested or that were pre agreed and notified to you. This will commonly include money transmission (cheques and credits), facility fees (arrangement renewal and temporary), stopped cheque charges, acquiring charges and the monthly maintenance charge any of which may have been included in your claim. We also reject any submitted claim that includes 3rd party fees, usually incurred in th esubmission of a claim, as these may not be included either now or indeed at a subsequent court submission"

    They went on to as him for a specific breakdown of the overdarft charges he refers to but we used their statements to highlight these charge. On the bank statements there was an item called Total Charges and we included these in the claim but the bank say that "this is not sufficient as it compromises a number of various charging components which must be split out and itemised for the purpose of the claim".
    What does all of this mean and what should we do next. The bank have given him 8 weeks to respond. Thanks for taking the time to read this and hope you can help.

    Yes the court was Gloucester, all we did for the particulars was detail what each charge was for and a short covering letter claiming that these charges were not resonable and fair. We sent this to the court and SCAM. However, with the postal strike the letter would have been delayed and this happened with the letters from SCAM which were dated 10th July although we got them on the 15th which was before they recieved ours.

  • Really not sure if im doing this right? Anyway, im in need of some advice! Im in the process of reclaiming my bank charges from Lloyds TSB. Ive got the charges details, sent asking for money back, told no and are lawfull, as i expected, sent letter saying going to court unless they give me my money back. Its now been 52 days and heard nothing. Rang and was told theres a back log and to be patient for another couple of weeks? Should i wait to see their reply or start court papaerwork???
