Hi,
Been going through the process since late Dec, i have my court hearing next week but since starting claim i have emmigrated to New Zealand and cant get back for court. I have requested the judge proceed in my absence and explained why. I have given TSB their 7 days notice and provided all parties with disclosure of my supporting evidence
Can anyone tell me if me not being there will reduce my chances and how does the court notify me of the decision?
In the meantime i will try ring the court but any info / anyone with same experience please let me know.
Claimed just over £3000 so i would be gutted if its gonna go topsy turvey.0 -
Can any one tell me what my next step is, I gave Barclays 14 days to accept my offer (75% of total), but they came back and told me it could take 4 to 6 weeks. Should I just go with the flow or demand they give me my money
We wrote back giving them 14 days to pay up or else, but heard nothing.
We decided to just wait and see and today (about 11 weeks after writing the 1st demand letter) they made an offer of £3,150 which brother is accepting.
He didn't really want to have to go to court, so he is well pleased with this settlement which only took three letters!You don't get medals for sitting in the trenches.0 -

With this sites help I started the process in May 2007. They dealt with the claim and offered me £1,500 this is without going to court. They said it was a goodwill gesture. Althiugh this is not the full ammount I think its a fair deal.

I am sure I am owed a small fortune in bank charges, but heres the problem< I have bed debt with the banks I want to claim from. I am scared they esculate their claim against me,and go after securing my debt against my home, or persue me through courts.0

Even if they have defended, your bank will not be willing to go to court and defend it. Its a way of buying time to get you to accept a lower offer. You may not realise it but you actually have the advantage here as you have started the court proceedings. Try writing a letter like I did to Capital One (link below), they had entered a defence at court too but it didn't stop them from increasing their offer from £303 to £1,489 over night

They can't escalate it. Hi folks, just a quick panic over my half success!!!
Wrote to Halifax to claim £2350ish and have recieved an offer of £1236 that has already been put into my account. I plan to ring tomorrow to ask for the full amount but what do i say, i've seen the "no predudice" but what does that mean?
